(2/3) If "Pingu" is a registered trade mark, you can not use it on a video with fee-paying ads, but still this is not copyright infringement. This is one of the problems with the nonesense term "Intellectual Property"; it gathers unrelated legislation under one umbrella with a big © written on it. This fuzziness enables Copyright holders to use sleight of hand in their favour.
