This bill violates Due Process by giving the SoS unlimited discretion to remove a candidate from teh ballot; the bill does not define "reasonable suspicion." And as written, the bill is unconstitutional, violating Article II Clause V of the Constitution.

@barefoot612 sorry barefoot, Hawaii since the mid 90's has only offered the Certificate of Live Birth aka Short form. That is an official record of what is available on file at the Dept. Of Health. there is no such thing as a Long form; it hasn't existed in Hawaii since the mid 80's. And the "long form" of old (before 1990) is no longer VALID. So if one presents their long form, they would actually have to go down to the Dept. Of Health to get it re-certified. and guess what form they will give?

Just to clarify (I am not taking sides here) -
Anchor babies are NOT Natural Born Citizens.
Not by the requirements set forth in the Constitution.
In order to qualify as Natural Born both parents must be citizens.
So, the children of an anchor baby (assuming they marry another legal citizen) would be Natural Born Citizens, but the parents can never be.

@clarity023 Re: WKim case, that is your best argument. Yet the dissenting opinion makes my case and points out the errors made by the majority opinion re: NBC. Further more in the judicial ruling they don't use the "NBC", only in the opinion. The fact of the matter is at times the courts get it wrong & The case didn't deal with a president. There is a lot of evidence that the framers did not want a president with split allegiance & is why they inserted the NBC clause.

@Elite59 Actually, Mr. Historian, Washington had 2 books that he did not return. One was "The Law of Nations", the other was the 12th volume of a 14-vol. set of debates from the English House of Commons. But that really does not matter, since Washington was not one of the writers of the Constitution,so his familiarity with de Vattel would not have made its way into the Constitution.

For all we know, he sat at the head table and voiced an opinion on every line set to paper. Or perhaps he just wandered the room, holding conversations with old friends and drinking tea. This bill violates Due Process by giving the SoS unlimited discretion to remove a candidate from teh ballot; the bill does not define "reasonable suspicion." If applied to Obama, it would violate Full Faith and Credit by refusing to acknowledge the HI birth certificate.
And as written, the bill is unconstitutional, violating Article II Clause V of the Constitution.

@barefoot612 sorry barefoot, Hawaii since the mid 90's has only offered the Certificate of Live Birth aka Short form. That is an official record of what is available on file at the Dept. Of Health. there is no such thing as a Long form; it hasn't existed in Hawaii since the mid 80's. And the "long form" of old (before 1990) is no longer VALID. So if one presents their long form, they would actually have to go down to the Dept. Of Health to get it re-certified. and guess what form they will give?

Even if the Arizona bill passed, if Obama up for reelection provided the form of which was scanned and posted to his site, by FEDERAL LAW, that original form would have to BE ACCEPTED by the Election committee of Arizona. The bill cannot and the SOS would have no power to reject any form that is offered by candiates. EPIC fail legislation

@barefoot612 Unfortunately you're simply incorrect. The COLB is an official HI birth certificate, accepted for drivers licenses, passports, and all transactions. If there is a single transaction for which a COLB is NOT acceptable, cite an actual example.
The only waste of taxpayer money comes from birthers filing ridiculous lawsuits that are chock full of legal and factual falsehoods, wasting valuable court time.
