Yes, Vattel is cited by the SC often, but Lynch v Clarke and Wong Kim Ark both speak pretty directly on what constitutes a natural born citizen, and both say that your interpretation is incorrect. They are both still valid caselaw and would be precedent for any future case on this.

And it's pretty rare for the SC to issue any opinion at all when they deny cert, so I wouldn't hold my breath for any opinion from them in Donofrio or any other NBC case.

I hate to tell you this, but one look at Lynch v. Clarke and I see nothing but a bunch of cases after that that disagreed with that judge. They said that the judge in Lynch was making up law, not interpreting it. He said that's not judicial, it's legislative. Lynch judge decided that he didn't want a bunch of "alien generations" running around so that's why he decided what he did. What the hell kind of bs is that for a judge? Truth is, I can name 50 cases that disagree with you too.

Germany is no where near democratic. A girl in my class just came here from there because her parents want her to have a chance at college. In Germany you go to school for 13 years,then are forced into serving the governemnt for a year, then only a select few get to go to college, in Germany you MUST take care of your parents - it is part of their constitution..nursing homes are only for the people whose kids have died. Germans' freedoms aren't at all like our freedoms.

Also, in Germany kids have to be really good at their extracurricular activites. A school bands came here to talk to us, they are much better at music than we are, but that's because only 3 kids in the whole orchestra play sports (this was 8th grade)the school (government) wants you excel at one thing so you don't try everything like you do here

Yeah, I had a friend in the Navy who grew up in Germany. I do think there's still something to be said for a rounded, liberal arts education but it's interesting.

This is not the Berg case, this is the Donofrio case - there are 14 such cases across the country right now.He has to show it to the states' attorney generals where he was on the ballot, but the states where the law applied did not due their due dilegence.

And yes, we are trying to uphold Constitution's provision for Presidential loyalty to America. I'm not sure this CNN guy is correct when he says it's being argued that *both* parents had to be citizens of the US. My understanding is it's ok if one parent has foreign citizenship if it is not transfered to child at birth, which is what happened in BO's case with UK law.

It only takes one senator and one congressman to request a stay of election until Obama shows proof. If they don't stand up before Jan 20 it's all over for America. God's gable is gonna fall.
