  • @FrankDekal Agreed. Unfortunately here, when he asked if he could leave, was told he was being detained, and had no recourse against the constitution violating officers. Here, even had he immediately not engaged, as you suggest, he would have almost certainly been detained then too, considering as soon as he tried he was anyways. Your solution only works with officers who follow the law. You can't win when dealing with criminals who power trip when they wear a badge.

  • @3Skitz1Production3 Who am I? I am a citizen, lawfully exercising his God given right to keep and bear arms. The beautiful thing about God given rights is that they are unqualified; meaning they need no standard of excellence or justification in order to exercise. Like God, they simply are.

    As long as I exercise my rights in a lawful and safe manner the police should be silent on such matters. We are citizens and thus sovereign, not subjects to be bullied or intimidated.

Question- If I as a LEO, have the right to ID you, why would I ask for it? Ummmm, because if YOU give it to me, then YOU have no civil suit for violation of your 4th, right?

  • @FrankDekal I've tried that and the LEOs simply sidestep the question by asking a different question. If I had tried to leave after they refused to answer my question they wouldve said I was fleeing and elduing and I wouldve been arrested.

    I gave him my ID because he had to write me a ticket for the bicycle license. Are you saying I should've still refused to submit my ID?

  • @cmdriceman71 No, that's not what I'm saying. Always invoke your 5th.  You can't be charged for fleeing if you are not the subject of a crime. Hence, the question. Are you investigating a crime? That bicycle ticket was a BS thing to get around their invasion of your rights, as you found out later. If it were me, I ask the question. If they don't answer in the affirmative, I walk away. You didn't walk away. You engaged them, made them mad, so they wrote you an ATTITUDE TICKET.

  • It seems to me that this guy was minding his own business, and policeman was trolling trying to get the guy to do something stupid. If the cop's suspicion was that this guy was a felon and could show probable cause, then his actions would have been justified. I am a law abiding citizen, however I don't see why I can't stand up for my constitutional right to remain silent, or open carry. The policeman seemed to want to harass giving a (Bogus) bike Lic ticket. Lucky this guy was recording.

  • @DeLaguna Thanks for your support. If a LEO has "probable cause" that means they now have enough evidence to make an arrest. "Reasonable Suspicion" means that they have enough hard, factual, and articulative evidence of criminal activity to stop and detain you for further questioning. In my case the LEOs had neither, they went on an unwarranted "fishing expedition," holding my liberty and property hostage until they found something.

This is why I support CCW's over Open carry. Also better to have the element of surprise when defending yourself rather than the enemy knowing exactly how much force they have to use.

  • @DeLaguna If you’ve been accosted by a criminal pointing his gun at your vitals then you have already been surprised and thus youre already behind the defensive curve and need to catch-up. A gun in an openly carried holster is better than one drawn and dispensing bullets; concealed carry forces the latter. An OCed pistol serves as a powerful visual deterrent so that the criminal chooses another victim.

  • @DeLaguna You assume that a criminal is somehow made miraculously braver because he has a gun in his possession and he will knowingly engage an armed citizen. At their core, most criminals are cowards; the last thing they want is a fair fight where they could possibly be injured or killed. They desire a safe working environment just like any other person. CCers are attacked all the time BECAUSE they look unarmed like everyone else, OCers not so much.

You could have refused to answer the questions initially but instead lectured the cop. Could have just explained that you was exercising the right to answer only those questions required to by law and left the lectures to the lawyers.   • I can stop anybody anytime I want. It is sad that the police really believe this. For some reason right to travel has been ignored as a constitutional right in America. The police have to suspect you have committed a crime or are about to commit a crime to stop you. It saddens me to see people stopped for nothing and thinking just because the police are being courteous you should cooperate. It is also sad that police think you should be grateful they are being nice to you.

The people that get upset over it are the people that have nothing better to do. How do you think people get caught at Airports trying to smuggle drugs and such? Many of them by random searches. I've been stopped for speeding, showed the Officer my CCP and was on my way in 10 minutes..no big deal, no skin off my back.

At that point they have become nothing more than terrorists with a badge. I do not negotiate or “cooperate” with terrorists. As agents of the State the burden of proof is upon the officer(s) to articulate (within a legal framework) why they are taking any of those aforementioned items away - in my case they failed to do so.

At least highway robbers are honest about what they do, which is more that we can say about these officers. Be honest, cowboy.   • @tmoallen How is this an illegal stop? The officer kindly asked how he was doing and immediately he went on the defensive by asking if he was being "detained". The officer was very respectful to him but for some reason he didn't reciprocate, so that leads us to believe he got what he was looking for...a confrontation. To me, thats a big "red flag" and Im glad the officer pursued it further.

  • @cowboy82272 It became an illegal stop the moment he officer said that he was not being detained but was not free to go. If you are not being detain by law you are free to go. To detain an officer must have REASONABLE SUSPICION that a crime has been or is about to be committed. Hunches, "red flags", or lawful actions(open-carry) do not constitute reasonable suspicion, nor does respect or lack of, although I have a hard time seeing how a cursing officer is showing respect. Educate yourself, sir.

When OCing we should all where a recorder and video if possible because the leos in this state and especially this city trained to be ignorant tyrants. just this year alone i've spent over 200 hours incarcerated because of open carry stops by cops who had nothing better to do thabn to "go fishing" instead of doing some real police work.

  • Correct me if I'm wrong... , if you are out in public, Police Officers have the right to ask you to state your business, regardless of your conduct. If you had cooperated with the police they would have left you alone. I know not every COP is honest, but you have to take a chance when you are open carrying. Get your CCW and ride around on your bike, they'll never know you have a weapon.

    There is no doubt that you have the RKBA, but you also have to prove that you have peaceful intentions.

I have not purchased hydroponics equipment BTW it was just a part of my argument to make a point. I can build most of it myself anyhow without it being labeled as hydro equipment.

Sure, the police can stop him, engage him in consensual casual conversation and see what he is doing but they may not detain him or his property without reasonable suspicion of a crime.     To make it worse most states require a license or permit either way permission to carry concealed making concealed carry a privilege not a right. So it's worse than a bribe because you have to get finger printed, background checked, (in some states) explain why you want one, AND pay a fee to have this done to you.

    So open carry is the only right that you have in most states. Then when you do the cops want to stop and harass you.

  • @ginolevino Furthermore as a law-abiding citizen you have a right to privacy, a right to anonymity, and the presumption of innocence - in short you do not have to prove anything; the State must prove your guilt.

  • Some states are “stop and identify” states, however Michigan isn’t one of them. It’s true a LEO can engage a citizen in casual conversation in an attempt to further “investigate” so as to ascertain whether criminal activity is afoot. But until officers have facts rising to the level of reasonable articulated suspicion of criminal activity they do NOT have the power to DETAIN a law-abiding citizen. In short they cannot hold you for 20 mins while they go on an unwarranted fishing expedition.

  • @ginolevino Concealed carry IS the best thing for me since I do NOT attract any attention. I can go into a known bad area and appear same as the next "sheeple" to those that pray on peaceful citizens, as well as appear to mean no harm to the citizens themselves.

    It is reasonable to assume that me walking down the street in the subdivision I live in, with guns showing, while kids run around and neighbors walk their dogs, would rise suspicion and calls to police would be made.

    We do not live in the "wild wild west". We do not have to fend from gangs trying to take our chickens and women. While it IS our right to bear arms, you have to do so WITHOUT disturbing peace. I cannot do that in my neighborhood. The old ladies peeking out the window won't even let me park my trailer in the driveway for one day (has to go on the side of the house)

You asked about walking through your subdivision and them calling the police on you, well my answer to this sir is that their not your neighbors. These people are just strangers who live in close proximity to you. I personallly oc in my neighborhood which is aproximately a total of 8 blocks long and 5 blocks wide and have no problems cause the people know me and are real neighbors.

This guy had on a Police Like reflective jacket,gun belt over the jacket across his back,2 guns on his back riding a bike.The 12th precinct has 2 parking lots he rode his bike back and forth for 45 min and when the police did not stop him he flipped his bike upstide down on the side walk next to front doors for 25 min. Finally when the police did not stop him he attempted to walk inside the precinct armed with 2 loaded guns. Hes unstable and appears mental.

  • @akaknocksville I presented my I.D. only because I was under the impression that I'd broken the law by riding a bicycle without a license. I presented my I.D. so he could write me a ticket for that, but I never presented my I.D. for openly carrying handguns.

    There has been talk about registering bicycles in different cities in my state. It would not a be license for the rider only for the bike. However it would, in effect, make it illegal for anyone from outside the city to ride through those cities.

    So what does a the testing for a license to ride a bicycle entail?

  • @cmdriceman71 I'm sorry but these officers exercised enormous restraint and trust when they realized that a holstered open carry firearm is probably the least of your worries, and treated you respectfully with non-confrontational questions in response to 911 calls about a man with a gun. They knew what was up, and if you had extended the same courtesy as professional and human beings, there wouldn't have been any confrontation.

    You give gun owners a bad name and that includes me.

Second if he did it wouldn't be because of Open Carry advocates exercising there God given right, it would be because the were going to take them away anyway. You need to make more sense when you talk. Open Carry is legal in most states period. These cops where violating this guys rights and harassing him.

  • The policemen did take my guns and they ran the serial numbers to ensure they were registered and belonged to me. The problem with that is that they had no reasonable suspicion of a crime. In the state of Michigan, as long as citizens are conducting themselves in a lawful manner police don’t have the authority to detain them or demand I.D.. In short citizens have a right to anonymity. Research the 4th Amendment and the history behind it and then you’ll see "what’s wrong with that."

  • I agree with the statement you were trying to make but clearly you were probing for a reaction from the police seeing as your riding around with two handguns and some type of audio recorder. I could see one but two? Its really not practical in a self defense situation and probably will cause more harm but anyways i suppose you always have an audio recorder because you dont trust the police and blah blah

    The police record themseleves with dashboard cameras so as to preempt any second guessing by prosecutors or defense attorneys when they have to use their weapon. When my life is hanging in the balance in a court of law after a self-defense shooting, my recording may be the only thing that's keeps me from going to prison. How is that impractical?

  • I have mad respect for Detroit police. HOWEVER If you are openly carrying 1, 2, or even 3 pistols the police do not have a right to stop you unless they feel you are in the "wrong doing" a guy riding his bike simply openenly carrying is not "doing wrong" I disagree this officer he is just being a total dick. If you have a CPL you have to identify it upon police presence. If he said no then the officer should presume that he does not. AND you DO NOT have to have ID. UNLESS you are driving.

    It was clear from the beginning I wasn't carrying a concealed pistol, even the officers who stopped me said as much, thus the aforementioned statute didn't apply to me.

    5:04 No, you don't need to have an ID on you. You only need to have an ID when you are operating a motor vehicle. You're on a bike, ergo, you don't need any form of ID. All you're legally bound to do (as far as I know) is state your name. Nothing more.

    5:35 He should not be able to issue you a citation even if there is some crazy bike license law on the books. He had no probably cause to stop and search you. (I did see that the bike license was repealed 2+ yrs ago).

  • @ghotioutofh2o If I can recall a few years ago there was talk in Detroit about making it a crime if you were over the age of 18 and did not carry some form of I.D. within the city limits. However this didnt mean you had to actually present it to a LEO when stopped without reasonable suspicion, but you at least had to be in possession of said I.D.

  • @ghotioutofh2o What's more, "probable cause" is when a LEO has enough evidence to make an arrest while "reasonable suspicion" is when a LEO has some hard or factual evidence (that can be presented or articulated in a court of law) that a crime has happened, is currently happening or is imminent. I already knew that the officers in question had neither.

  • @ghotioutofh2o if you listen to the beginning of the clip this was an open and close case i find that several citizens openly carry just to create situations like such. when faced with situation like this i just ask a few probing questions to find out the mental/emotional capacity (which is well within reason) and provided the civilian cooperates I engage in no further investigation. But yes you are required by law to posses a valid State ID and present it to law enforcement upon request.

    By your own implications, the open-carrying people that you encounter are guilty until proven innocent. I don't know what they taught you LEO school, but that's not the way the US works [or should work].

Yes civilians are innocent, but proper investigation should take place. Putting yourself in the position of a potential victim if you are taking your child out of the car and someone on a bike harms you and your child, but no more than five minutes ago a police officer came in contact with the perp and didn't even bother to investigate him how would you take that

    I would take that as the victim should be aware of his surroundings and should be carrying too.

    What you are trying to accomplish with these random "investigations" is taking away liberty for the [false] sense of security. And as we know, those who give up the former for the latter deserve neither.

    Correction: more than half the violence in the city of Detroit could be prevented if more law-abiding citizens were armed.

  • @ghotioutofh2o I truly enjoy this dialogue as i welcome other perceptions. Abiding by the laws is not abnormal however certain laws do impede safety. A man walking down the street with an AR-15 is legal but abnormal to see and just as an LEO i would investigate.

  • @ghotioutofh2o Just as if someone driving a car swerves just a little an LEO may initiate a stop just to investigate the state of the driver although an occasional swerve is not against the law. Although it doesn't stop crime it gives police presence it tells criminals that the police are out looking and citizens that we are making an attempt.

    Although i whole heatedly support cpl licensing i don't think in fact i know that more cpl holders would not prevent crime.

  • @ghotioutofh2o My father (who is LE) and mother were robbed at gun point my two individuals who her spotted by they were on them to quick to draw his weapon and his good judgement of not drawing possible saved my mothers life.Im not so sure although citizens a re legally caring that they have that good judgement variable ive seen fist have numerous situations gone bad a cpl holder shot because he is trying to draw after the perp is already on him. So maybe more bodies would just start turning up

  • @ghotioutofh2o more than half of the violence in the city of Detroit could be prevented if LE was allowed to do more proactive maintenance i can't tell you how many times I seen a situation where i KNEW it was gonna go bad but we couldn't do anything because of a law or something impeding real police work (arresting a child support case, while a child rape is in progress) it pisses me off !!!

  • @ghotioutofh2o law enforcement officers are put in place to look for abnormal situations and investigate carrying two gun open is not normal. People always say someone is being killed while we are harassing but a simpleton trying to prove a point tied up a unit. because by law we should be out investigating its called being proactive. How would i feel as LE if i just waved to a guy with to guns then later on a call comes across of a violent crime committed buy the same guy
