Furthermore, the Supreme Court in Boumediene v. Bush ruled that the Guantanamo prisoners had habeas corpus rights. I realize that doesn't jibe with your right wing fantasy world, but you can look it up.
Except that Guantanamo was held to be functionally American territory and under American sovereignty by the Supreme Court in Boumediene. Boumediene does not say that the Bay is beyond the territorial scope or jurisdiction of the United States.
So again, habeas has no extra-territorial application to non-citizens. Look up Johnson v. Eisentrager.
You also fail to answer the fact that the 4th does not apply to foreigners extraterritorially. You lose.

I also believe that the people on our side who were tortured, if asked whether torture was morally wrong, would say yes. Don't know about you, but I would like to be able to say with some confidence that my country is morally superior to its enemies.
