  • Actually it depends on the state your in. For example in Massachusetts you must show your gun permit upon demand of a Police Officer under state law.

  • The problem in discussing this stop and detaining the four on youtube is RIDDLY DIDDLY failed to report any facts again.

  • Police are power hungry corrupt scum bags...this just proves what I have always said about cops.

  • patriot, get the fuck over it.

  • you claim to be a American Patriot, but actually your a coward. Your no Patriot, your a anti-gun liberal that doesn't know what American Rights are.

  • @taurusmaroon5 - I know I'm a little late to the party, but you know Ridley is a free-stater and open carries, right?

  • Dude, you suck and hope you need the cops one day and they never respond!

  • @BackdoorBandit956 | he won't need them, HE'LL BE CARRYING A GUN.

  • The Law give limited power to the police and there are reasons for that but the police over stepped it when they hassle people in minor issues and they make it a political issue, people who don't like guns are ignorant and mentally blinded and if they feel the have to hassle gun owners they should move to mASSachusetts or New Jersey.

  • Can you respect peoples right to carry fire arms? My request is backed by the constitution of the United States of America, what about yours?

  • But police questioning people does not solve the problem in your argument. If a police questions some one and determines them to not be a threat, they still have their gun. The justification you used was that people are afraid of guns and don't want them around. The gun is still "around."

"right to the pursuit of hapiness"

So if I see you buy booze in the liquor store, it's OK for me to ask the cops to stop you? After all, it scares me that you may be drinking the booze while driving.

A black man driving in a white area of town scares you. Do you think it's OK to call the cops to stop him?

You seem to think YOUR rights are more important than the rights of others. YES YES there you go!

  • The term "pursuit of happiness" is in the Declaration of Independence, which is not a governing document like the Constitution. Maybe a history lesson is in order?

  • it all stems from the founding fathers mens rea. go find a cream filled hot dog!

  • Actually the Declaration of Independence is thee American document. there is no America without that document. The Declaration of Independence is the first and foremost legal document of this country. The document had to be completely unanimous by all the congressmen of the original thirteen colonies before it could be passed.

  • @unklejman Are they part of a well regulated militia? I seem to remember that being part of the 2nd Amendment.

  • and this would be spam because....?

  • Because reason and logic are not welcome here

  • And, if the stop itself is unlawful, neither Terry nor Michigan v.

Long authorize the police to search the suspects or the suspect's vehicle for weapons, even if the

officers reasonably fear for their safety."

    Likewise, the U.S. Supreme Court in Florida v. J.L., 529 U.S. 266 (2000), declared that there is

no "gun exception" to the Fourth Amendment.

  • also United States v. Dudley, 854 F. Supp. 570 (S.D.Ind. 1994), in which the court declared that

a report of persons with guns did not justify an investigative stop. "In short, the Government

failed to establish . . . that some reasonable suspicion of criminal activity, based on articulable

    facts, justified this seizure..

  • "For all the officers knew, even assuming the reliability of the tip that Ubiles

possessed a gun, Ubiles was . . . lawfully exercising his right . . . to possess a gun in public." See

  • ive had police encounters with my open carry here in georgia they refuse to acknowledge this fact below:

On the issue of whether a firearm, by itself, justifies detaining and investigating a person, there

are many federal cases addressing the issue. United States v. Ubiles, 224 F.3d 213 (3d Cir.

2000) declares that possession of a firearm in public, with no other circumstances present, does

    not justify a stop.

  • He didn't really give an answer. He just said that the police do their job. It seems to me that they have over-stepped their bounds.

  • He also said he didn't know the facts of the case. Now while this may seem to be backing away from the issue, the fact is he didn't know the facts of the case. And he was honest enough to say that's why he couldn't make a comment on that case.

Now the fact that he trusts the police to do their job first, well, some people trust the police some don't. I may disagree with him on that but it's an honest disagreement rather than either of us ignoring facts.

I think the alderman did ok.

  • The dude just said he didn't know enough about the situation to offer an opinion. It is good of the Ridley Report to inform him that they that open carried did nothing wrong.

However, if a shop owner does not want guns in their shop, shouldn't they be allowed to restrict carrying them in their shop, either openly or concealed?

  • Let the owner put up a sign, then.

"No Guns. Only criminals will carry weapons in my shop."

  • He's hypmo-tized by the badges.

  • Hmm...Makes me question my support for these things (Spending Caps)..Whenever I hear someone say "I'm a senior citizen and I..." it is usually followed by a non-reasoned assertion of the goodness of something :)

  • If they police were folowing the law, they would not have stoped them.

  • As always, *****, commented and favorited!
