This song was a staple of my childhood. :) My parents owned the CD this is on (Time, Love and Tenderness). Sadly, it's gone now, but I will try to pick up a used copy. I would listen to it constantly (I was a huge Michael Bolton fan when I was very young). Thank you so much for perserving some very happy memories. :')

@fausto412 But i understand now. It is the chorus similarities that were in question here. The lyrics, the cadence of the lyrics/melody of the chorus, the note progression and fade out. These things on their own would have been non-copyrightable by themselves, but chained together they are. All the plaintiff needed was to show a likelihood of Balton having heard the original to convince the court and jury. Balton was known for reviving old soul music, so that possibility was easy to establish.
