I'm not sure you can assume the Colbert Report stole your idea. I mean, they film those shows in the afternoon, so that would mean one of their writers saw your video, found the footage, wrote the joke, changed the script from what it was going to be, and shot it all within a few hours of seeing your video. I think it is more likely they had a similar idea when viewing the ABC show. It's not exactly a revelation to notice obvious product placement and realize the stupidity of using terrorists.

hank green from the vlogbrothers had the same thing happen to him. he posted a video awhile back with anagrams for democratic presidential candidates (obama, clinton, edwards) and a few days (maybe a week, i'm not sure) later, some of the same/similar ones were featured on the colbert report. who really cares though, since stephen is the funniest guy on tv.

tThe part about Stephen Colbert stealing my idea IS a joke as I'm fairly certain The Colbert Report was produced that day before my video was uploaded. What isn't a joke is the general point about a lack of clarity regarding intellectual property and who is infringing on whom.

Yeah as far as Colbert Report material, I think it's written in a combination of the night before and the morning of, which allows about 12 hours to plan out how the show will go... I think it was coincidental. You might be inclined to think otherwise.

For a pretty good description of "the point," see caffeina's comment. The only amendment I'd make is to take cafeina's word "meaningless" and switch it for something like "baffling." I'm not saying there are NO intellectual property rights, just that they're hard to figure out, especially when you're trying to be "free."
