Is the Vice President a part of the Executive branch or Legislative Branch?
Palin: Agrees with Cheney in that it is a part of the Legislature.
Biden: Disagrees that the position is a part of the Executive except for voting in Senate ties.
Constitution: Unclear. It defines the role of the President of the Senate (Vice President) in Article I (Legislative Branch), but also defines other roles and qualifications in Article II (Executive Branch).
