Heres some things they dont mention, #1 unencrypted wifi broadcast's are perfectly legal to access and sniff aslong (by encryption that also includes internet traffic suck as SSL certifications or anything from of packet encryption) wardriving it self is not ilegal. As for the "illegal" aspects there are ways around that, such as using a fake AP "phishing" attack, as all data is on your network in this method it becomes 100% legal for you to "audit" the packet information, encrypted or not.

They were using Netstumbler. Most routers today are unsecured but as 2wires coming out and being the primary field router for AT&T U-Verse they are protected using WPA2 and its a little harder to crack than WEP. If you are a serius hacker you would be using Backtrack. but yes many phones also are setup to connect to the strongest open wifi network. if you want to protect yourself I would hide SSID and put WP2 with a strong password. or make a virtual wifi lan and use it as a honey pot.
If you know for sure that there was someone that hacked in to your network, and you want to report it, i would first go into the router's console and check for the mac and ip address. If that doesn't show then they have their macs hidden or spoofed and/or the router erased it from the log after a certain period of time. A honey pot is a good defense if you know how to use it. Keep all logs on that interface and make sure you back them up and most importantly your router's configuration.

MAC filtering is about as worthless as WEP encryption. Your AP is just itchin' to give out the MACs that are allowed. Plus, you can just fake the MAC that matches with a comp that's already authenticated. Don't get me wrong, it *helps*, but it is by no means more secure.

This can be innocent or it can be illegal. Depends on what your doing, just getting internet access or are you trying to get private info. I mean, I could capture private info, if i wanted to...I live where there are hundreds of unsecured networks, and secured ones also that can be cracked, but I choose not to do it. There are enuf legal hotspots that i dont have to ward someone's.

MAC filtering is about as worthless as WEP encryption. Your AP is just itchin' to give out the MACs that are allowed. Plus, you can just fake the MAC that matches with a comp that's already authenticated. Don't get me wrong, it *helps*, but it is by no means more secure.

use wpa psk tkip with a strong passphrase that
will pretty much garauntee no one will get into
your network, if u use a wep key most likely
a hacker driving by isnt going to bother trying
to catch a million packets to crack it, since
over 60% of morons dont even secure it, but if you use wep change the password every week
or just use wpa with a strong password.

Wardriving is not hacking; its scanning for open wireless access points. Active wardriving is perfectly legal. By the way, in some states, connecting to unprotected AP's is perfectly legal. Even if you use WEP encryption, you are still vulnerable to attacks.
