  • It's called manslaughter, not murder. He most likely didn't plan to get drunk and kill people in a taxi. His reckless actions have caused the death of another man, therefore he'll be tried for manslaughter. You have to take into consideration the fact he was drunk. If he had been completely sober, he would've got a much longer sentence because he should've been completely aware of his actions. However, since he was drink, he can't be considered 100% under control of his actions.

  • @martinbrownson Sorry, but that can be "charged" with 'murder'. Pre-meditated or planned? No these are not the necessary elements. And in this case I think its a yes, since the death is caused by the ausses' dangerous drunk driving behaviour. In HK, case of dangerous driving behaviour, that cause death, can be charged with Murder. Not necessary to be intended/planned or what so ever to lay such a charge on the driver.

A local drunk driver was sent down for 6 years for causing death while under the influence of alcohol, and he plead guilty and showed genuine remorse from the beginning, none of this web support group begging for defence fees and mitigation BS..

  • the taxi driver was apparently caught up in the driver's seat belt whist outside the taxi, which may explain why the fatal injuries that the taxi driver suffered could not have been caused whilst inside the vehicle...and hence the initial more serious charge of murder....

  • Well, looks like all you doubters have peed into the wind based on the reported court testimony of two eyewitnesses that the taxi before the crash was stationary on the left hand side of the road, that the taxi driver was arguing with the accused standing outside his vehicle, that the tax sped off with the taxi driver running parallel begging the driver to stop, that the taxi driver was sandwiched into the central concrete divider and eventually the central railings by the stolen taxi...

  • Everything in this video is hearsay. It is edited in such a manner as to portray this Australian in a bad light - at best one can see that the paramedics did a terrible job of removing the Aussie from the wrecked car. For anyone who has watched this more than once you can tell he is in no way attempting to flee the scene as he is indeed in the passenger seat. The media who reported on this story were clearly going for shock/awe rather than factual reporting. 100% yellow journalism if you ask me.

  • @martinbrownson I agree, the video is a little grainy, but it sure looks like the medic trips the gear selector, could have resulted in more deaths, there should be an investigation as to the practices of these reckless medics. That poor guy was just in the wrong place at the wrong time.

I see it all...An obviously injured Aussie Passenger irresponsibly left in a taxi, obviously sitting in the passenger seat, with what appears to be head injuries from the taxi drivers prior driving errors is supposedly trying to escapee from the scene by rolling away at about 3-5 km/hr with his foot obviously on the brake pedal!!! if he was guilty of anything why didnt the police have him under arrest. This a racially doctored farce.

  • He was always in police custody, contrary to the reporter's poor reporting. It looks like the last accident happened because the police didn't do their job. The Australian couldn't have known what was happening other than to avoid further calamity, out of self-preservation. He is out of it, in shock from whatever occurred before. This shows only a bungled accident scene and nothing further. It would be crazy if it were used to show / prove what supposedly happened prior to the video.

  • Yeah I see the same person just copy the TV clip many times which is illegal, why dont YouTube remove this? In any case you can see the car moves while the passenger is still in the passenger seat, Toyots have done that in the US too. Also taxis in Hong Kong look like they have no saftey equipment like airbaqgs (none seen here anyway) as they do in Japan. It seems Hong Kong taxis are dumbed down, like some of the comments here.

  • According to Hong Kong news, the police charge him for stealing vechicle and drunk driving, THEY DIDN'T CHARGE HIM FOR MURDER, I THINK AUSTRALIAN NEW REPORT IT WRONG.

    Also, by "driving off", Kelsey also endangered the oncoming taxi driver and 2 (rather hot chick) passengers - thank God no further injuries or deaths were caused.

    It is perfectly plausible Kelsey released the handbrake, got in the driver's seat and drove off. It took him less than 10 seconds to go 50m, basic applied mathematics tells you that kind of speed is not achieved from free rolling in neutral on that incline. Thank God the gear stick in HK taxi's are where the indicators are, or else he could have been going at greater speeds.

  • Great story, shame about the facts, Still waiting for the driver autopsy, and the witnesses to the alleged fight. Seems like a police frame up. I hope to hell I'm never a passenger in a car that crashes.. it seems the police now blame the passengers for accidents.

  • actually if you look closely it would appear that the taxi starts up by itself and the guy grabs the wheel to try to control it. thats even what he wrone on his facebook too. when i saw this on the news i thought 'great thats all we need another idiot in our great city' but now i'm not convinced he entended to drive off
