The construction company is not responsible nor would it be the State Mental Health Depts. because the bodies cannot be considered confirmed patients. The city should take responsibility but they probably don't want to spend the money. Good luck though.

In any case, cemeteries are an important source of local history, as well as a place for comfort and closure. Families of those who suffered any kind of illness should be given a place to grieve.

Older sanitariums/asylums were like that, especially the older ones. I can't say it isn't a big deal, as it is, but that was the way people were treated in those places.
