'We lost two engines and ran out of fuel' - an at controller must be able to realize what it means from pilots under extreme pressure. And the atc 'forgot' to inform them about the wind sheer at low altitude. Good job.
The controller had other planes to deal with and every time he asked if his instructions were okay the pilot said yes. There was no reason for him to believe he had to interrogate the pilot about his fuel situation. The only hint of a real problem came when the pilot asked for "priority," but in ATC lingo that just doesn't mean "emergency." I can't comment on the language barrier, but I think the controller's responsibility was ancillary at worst.
yrs ago Eastern flew to the west coast where it wud turn and follow along the coast. but not this time..
flight attendnts finished prep. 4 landing, buckled in to their jump seats and waited to land.
and waited. they realized there was no coast in sight, just ocean all around .finally they went to ask the pilot
. both pilots were fast asleep. there was no turning @ the coast, they just kept right on going straight out 2 sea. it wud b funny if they'd had extra fuel.
@linoleumcarving they didnt declare an emergency they said "priority" in spanish that means emergency but the control tower tought it wasnt so serius and they tought they had more fuel, also the control tower had the flight waiting for 1:45 mins in th air thats too much....
Had to hear this after reading "Outliers."

They certainly ran out of fuel and after long litigation, it was concluded that the blame was shared between ATC and the Avianca crew.
