  • When my cover of "Grandma got run over by a reindeer" was pulled with no warning and costing me my first strike, the publishing co. rep said she had no idea about me getting a strike. She further said that I should not suggest to other people who had posted covers that they should pull their cover before she "bombed" them. She called it "interfering" with their copyright. I looked into licensing this song and was told by a rep. of bmgchrysallis that it would cost $500 annually.

  • fuck Warner Chappell fuck them so hard... I hope they burn in hell for eternity.

  • if i find another video as great as this ill sleep outside!!

  • It's still up! :)

  • Hey, David! Think the music publishers are listening?

  • :S howcome david's partnered with youtube although he does many covers? or perhaps he actually got the license...

  • This is so true...

  • If you as a partner upload a video, isn't there a way to mark that video as non-profit?

I thought that was an option where you just don't display any ads at all for that specific video. That would make it legal.

  • Those "old" record companies should go the way of the dinosaur and make way for smart companies that are able to develop new business models and make money off of this. Greedy dumbasses. Since this was a old post , looks like you were able to keep your channel ... HAPPY. =)

  • @hahaits yea parodies are ok...

  • @JustAnotherMusicKid that's because some don't have licenses, and well, they can't cover the song, not theirs, so yeah, utube tracks that kinda stuff. Nowadays, it can get removed Sometimes, or just remove the "copyrighted" audio. Now, everyone does things illegal w/out knowing it is :/

  • Wait. You're not supposed to cover songs? ahaha why? its not like their not making money, and youre not stealing it. its just on YT most likely for fun and youre probably not even aking money on it so how is it stealing? why do they even care? thats so weird, i never knew that. everyone does it.. haha

  • Best way to copyright something on the cheap... copy your music/video to a CD then put it in sealed envelope, send it to yourself by registered mail. Keep all the receipts for registration at the post office and even the cash receipt with dates all intact etc. When you get your item put it somewhere safe and DON'T open it.

  • Bummer dude!

  • If you think about an artist taking time to write, sing and produce a song which may cost him/her considerable time and money then someone comes along and steals it for their video, it's not fair, is it? Most video producing software now has 'royalty free' music for you to put on your video, if not do a google search and get some, there's lots out there for free with no restrictions. Don't steal other's music to sell your video! The video isn't good if you need pop music to sell it!

  • try warner bros.

  • THANK YOU DAVID! NOW I KNOW WHY A COUPLE OF MY COVERS WERE BLOCKED :D

  • Hey what about making parody music videos of songs like davedays how does that work???

  • listen up people, do your part to fight greed and capitalism, download your music illegally and stick it to the man. so what if they only make 4 billion instead of the 5 billion they want. the record companies are run by fat rich dickheads who prabably dont even listen to music, fuck them.

  • Why why why does it have to be about the money? One of my vids where I make lasagna was taken down because I used Regina Spektor's "Us" in the background. This is a bit frustrating since there is no way to actually get permission from her or Warner music. Because it's all about the money.

  • I think what record companys are doing ( taking videos down from youtube artists ) is greed. They arent in a way losing money if anything that youtuber liked they're song so much that they tried it themsleves as david said there some people never knew the song until he did it so that would lead to them checking out the original, Justin Bieber ( dont reply hate ha ) started out doing covers on youtube because today how else does an unknown artist spread his talent?

  • publishing companies have every right to protect their intellectual property. you of all people should know that. if i was a songwriter, but had crappy youtubers making crappy covers, i'd want that shit off as well....esp when they are making money off my work.

  • @sakamuras

If David was selling an album of his covers then I would be the first to say that he is in the wrong. He's not.

Good covers OFTEN lead people to seek out & buy the original, in some cases changing the way you feel about the original artist. e.g. David's Hit Me Baby

I am guilted into playing my guitar/piano/or violin at family gatherings. Sometimes it's in a park sometimes it attracts a big crowd. Should I have to pay for performing it in public.

Where do you draw the line?

  • do you still make any money from a cover

  • this video helped alot

  • aren't song covers on youtube a form of advertising for the original songs?

  • SORY

  • Don't lose your music channel please! God bless you. We all love you and your music. You're so talented.!

  • behind you 100% David!

  • Isn't what a wonderful world a jazz standard?? How can they prevent people from playing it! I hate publishing companies, all they care about is money. They clearly don't care about the whole purpose of music...to spread it so people can enjoy it. Screw WMG, bunch of dinosaurs.

  • hey stay strong! for the love of music!

  • So what, cover bands are evil?! No one's allowed to even mutter song lyrics?

  • you are amazing and whoever took you down is just plain scared of your beauty

  • So is it wrong to want to use covers/your voice/performance to gain an audience for your original material? is that looked down upon? Cause I have a band with an EP soon to be made and covers seems just like a great way to get people to be interested in you and then perhaps your original music. it just makes sense. Can anyone give me some insight into that?

  • I couldn't agree more! The only CDs I own, I either discovered through Youtube or Youtube covers convinced me to buy them. The problem with everything nowadays is it's all about money, money, money. No one cares about the happiness it brings or the benefit it has to real people, just how it affects the bank account.

  • efliping stupid. everyone posts overs...

  • I am not buying any big label music until there are covers to check it out.

  • As long as it's not used to shed negative publicity on the original artist or band why make it a problem when someone uses a song in a video? Why is money an issue? The artist/band is getting free publicity around the world when a YouTuber samples it and if they like a song they might buy the album. Do radio stations pay to put a song on the air?

  • IT'S OKAY TO THOSE 9 PEOPLE WHO ACCIDENTALLY CLICKED DISLIKE! GO DAVID CHOI! FIGHT AGAINST THE POWER!! EVERYONE THUMBS UP THIS VIDEO!!!

  • I am so pissed off!!!! The public should be able to fight against the injustice of the greedy music companies!!! I was looking through my subscription box for one of the songs you did that I really reallly liked, only to find it empty...

    This is total Crap!

  • This makes me sooo angry!!! So sorry that they did this to your account! Ugh. Greedy bastards. You totally introduced me a lot of new songs that I'm sure Warner Bros or Sony made a profit because I bought the mp3 dang it! I hope you get your account back!

  • beautiful speech buh! but iz ur music as depressing as the way u talk in this vid ahahaha good luck with that...trlolololollooll

  • I agree w/ you we shouldn't let our old music die. *sigh*

  • if a music cover is on block, does it mean it'll be safe from people erasing it or anything?

  • The world is full of greed and power. Its hard for anyone to speak up to a person in power. The publishing companies won't listen to you. They won't care until everyone step up and get together. The history and now is the same. People have to get together in order to speak up against the power.

  • Awwww i wonder what happened to your channel! good luck in getting it back. Basically its not even about content and issue rights it all comes down to MONEY and how they can make more from it.

  • I don't understand this. Are people not allowed to even do covers anymore? O_o

These are the companies that are going to do down in the future--if they haven't already.

  • You sound so annoyed.... POOR YOU! BUT I MISS YOUR MUSIC SO MUCH ALREADY! I WANNA LISTEN! Stupid companies... argh... wow.... annoyed..... now i'm annoyed... -_-

  • I'm so sorry we can't do anything to help. I still went and bought your CDs just for good measure.

Good luck David, you have our support!

  • There's no reason in it. Look what they did to the Hitler (Der Untergang) parody videos. These YouTube videos opened the movie up to a whole new audience - even I bought the movie after seeing them.

    Deleted.

I'm a lazy 23 year old half-assed student, yet I'm apparently more capable than these people at handling marketing issues revolving around millions of dollars in revenue?

  • this sucks man im sorry for you dude:(

i mean what the hell its just a cover...

  • Come back we luv you!!!!!!!!!!!!!! Don't lose your David Choi Channel, find a way to work with them!!!!! David Choi!!!!!!!11

  • we all should move to another website like this

where we can post covers.... hahah

  • WOW, THAT'S SO LAME...

We love your videos, they can't take your videos away )))))))):!

  • It is getting ridiculous. You can't even do acoustic covers anymore. Do they really believe they are losing revenue from acoustic covers?

  • u cant do covers when a partner ?

  • music was made to share with people. why do ppl have to keep labeling songs and say who owns it. it totally ruins the what music was suppose to be in the first place. the whole world is so jacked up now. all everyone cares about is their own interest.

  • I miss the old youtube when they honestly didn't care about all this content-id crap. David, I hope you get your channel back.

  • @lovelaughandmusic Are we sure that the company's are Warner and Universal? Every one of David's subscribers should do a cover of these 2 songs and spam the internet to get the word out what is going on.

  • @cellunlockernet i agree we should do that lol

  • #freedavidchoimusic

  • thanks for this video and the part 2 as well david. very informative.

  • No one can stop the music!!!

  • Its all greed from the music industry. Their entire system is broken. Practically every artist in history has used covers to gain an audience. Does anyone think "Twist and Shout" was the Beatles song?

  • @ouchyg Twist and Shout is a song written by Phil Medley and Bert Berns but permission was given for the Beatles to use it! People can't just steal other peoples songs/music and make money from it or not! It's theft whether you like it or not and you can end up in court if it's pursued.

  • @ShoppingBargains -Permission was given to (probably purchased) to sell the song. Not to just sing it in their bedroom. That’s the issue we are talking about here. Ya its stealing if you try and sell it – but is it stealing to just cover a song? It used to be the highest form of flattery...

  • @ouchyg If an artist wants to cover someone else's song it's still the same issue. Permission must be given and/or payment made. Why do you think copyright exists? It's to protect the artists work. If you write a song and someone uses it without your permission and makes loads of cash, wouldn't you want a cut of that? After all, it is your work!

  • @ouchyg You say flattery but the artist might not see it that way, the artist might think you're doing more harm than good. Permission must still be given.

  • @ouchyg

    It's the Illuminati at work.

  • whats funny is teh coporate puppet justin beiber has a channel with no problem so he can plug his stuff whats the difference between justin beiber and this guy exept money? thumbs up for the youtube community?

  • It's the old, fat white guys with no grasp of the modern world that ruin it for the rest of us. Get with the times, you can't control the Internet. Might as well tag along for the ride.

  • @OneLoveJK Yeah, it's always those white guys... No one formerly at Motown or any current black-owned record label is trying to protect their copyrighted material, are they?

  • Damn them! We love you so much!

  • Wow. This is pretty lame actually. Jeez. Money isn't everything man!

  • My names David to lol thanks again ... David d

  • You introduced so many new artist ive never heard before and listening to your covers made me want to go out and buy there cd's ( which I did ) I'm only 16 and well you've shone me some pretty sick tracks thanks. ... David

  • @sil3ntsushi3 I totally agree with this statement. Covers on YouTube has always led me to finding great new artists and songs. It has never been a replacement for downloading or paying for something. It's always had the opposite effect of making me MORE interested. How dumb are the people who don't realize this??

  • That's really unfair! :/

I hope you get your channel back!

  • Screw them!

  • Yeah, this is lame. -_-

  • Then what about justin beiber

  • this is complete B.S. D:<

  • Is your music account suspended permanently or temporarily?

  • :o( sorry to hear about this. but thanks for taking out the time to explain everything... dang, this sucks... and it sucks that we can't help either =\...

    wish you the best, david!

  • >:OOO

    omfgshskdgha sdofi.

    omg (==).

    that sucks shit.

    deleting davidchoimusic.! D::::

    WHATTHEHECK.

  • noooooooooooooooooo his account is deleted nooooooo i miss that music :(

  • i dont think u can put ads on music covers

  • well some record lables are starting like look at vevo

  • Not surprised at all. Youtube is owned by Google which is in complicity with the Hollywood media conglomerates by Jewish association. But this was a mistake on their part. I believe that this will only cause independent artist to want to stay independent, and as David mentioned, there's no stopping it now. If Google wants to play capitalistic, then we shall see its demise soon enough as other outlets arise.

  • Yea I agree, they should ask you to remove the vid not suspend you.

  • the making money part.... (4:00)

    *COUGH* economy.

  • heard from happyslip that you got suspended. subbed to get you back on track!

  • corporate america is really depressing

  • WE LOVE YOU DAVID! <3 Good luck :D

  • holy shiets. frakkin old school companies. they have no idea how damaging they are going to be to themselves if they force youtube to take you down. there will be people boycotting them. what record company is this? i'm gonna mass email their frakkin ask. bastards. they better bring david choi music back.

  • @tewkewl Yeah, I mean he isnt doing any harm by singing songs! And if you notice on Justin Biebers channel none of his vids have been taken down (like the old cover songs!)

  • @RikkuTikku27 They Just Jealous That He Have Such A Amazing Voice.

And About Biebers.. Hmm Who's that?

Lolz Jk, I just Don't like Justin Bieber!

    =]

  • sometimes you really wonder what the companies think... uploading an original mp3 or tv show does cause them to lose revenue, so that i can understand. but uploading covers doesn't. it's ridiculous to think people will not buy the original song because a person supposedly covered it better. i don't know why they have to be so freaking anal about things like these. if these are the rules, then they ought to be changed. too bad we have no power to bring about these changes.

  • Ok JUST heard about this. wtffffffff not cool!

  • Thanks for the update, I was thinking 'what the...' when it said your account was suspended. Regarding covers, I think it also provides the artist exposure that they otherwise wouldn't get, like you alluded to. It turns people on to artists they otherwise wouldn't even know existed and I don't see how that can be all bad.

  • i think that its not youtube thats not the assholes, its the publishing companies that are the assholes. if youtube didnt come up with this three strike crap, then the publishing companies would end up suing them. meh just hope you get your channel back.....

  • Why the fuck are there 3 strikes for those stupid copyright rules? YouTube is badass!

  • btw i love ur By My Side Song. fucken lovee it :D.

  • well good point. but i got a question though.. like what if u suddenly hit the good spot and u become rich and copy right your own stuff... and i try to make a cover of ur beautiful song, would you get mad? or if some people put ur music up for free, ur losing money from all over the world. The Big Question is... Would You Be Mad? imagine being in the companies situation too... i like your point but you gotta consider other peoples point of view too. Good Luck Man.

  • @joshualor101 if people put your music up for free, then it causes you to lose money so that's wrong. if your song becomes incredibly popular, and another person covers it, and puts it up on youtube, i doubt you'll be mad, cuz it's ridiculous to think that this will cause you to lose money. Iyaz ran a series of videos thanking people for covering his songs. i doubt anyone is going to stop purchasing iyaz's songs just because another person covered it. but apparently warner doesn't believe so.

  • this is bullshit, they should be taking down all the other music channels too then

  • Noo :(

Honestly, because I see covers on youtube I've discovered new artists that I like, which usually leads to me buying their CD (although the covers themselves are freaking amazing as well).

I'm sure there are others out there like me, and yes, as you said, record companies should embrace the new age. Yeah, profit might go decrease a bit, but this is the chance for Them to get creative (as opposed to their artists) to find new ways of revenue.

Thanks for the informative video, David.

  • So heartbreaking. I hope you get your account back!! I love hearing your renditions of songs since they are SO MUCH BETTER than the originals. You also introduce me to songs that I've never heard before as well. I love your music!

  • i disliked it because of the news :(

  • seems like music is all about money nowaday...

i really hope you get back your channel

  • Warner is definitely horrible. They copyrighted the Happy Birthday song.......... So you can't sing it in public or you risk getting sued :]

  • Or don't put up copy righted music. Is it that hard?

  • @paintedd almost all music is copyrighted. you know how hard it is to get known by singing your own songs rather than singing a cover of a popular song?

  • @Daveiddt Oh I realize that, and I think it's unfortunate that Youtube has those copyright rules in effect, but the fact is, they're rules. Follow them and things like this won't happen. He has no one to blame but himself.

  • @paintedd You must work for MCA.. who is the embarrassing company that had David's videos taken down..

MCA has the option to make money from people who do covers like other large labels.. but instead it chooses to punish people who sing along to their songs.

    Sad company..

  • @cellunlockernet Hah, nope. I'm just a guy with a little thing called common sense, maybe you should use it some time.

  • @paintedd Hmm suspicious.. you talk about common sense? So you think it makes sense that companies are blocking people from singing and recording themselves? These are simple covers of songs.. look around.. it's everywhere.. what it actually does for these companies is promote the original songwriter and artist.. they can also choose to cash in from people doing covers.. this is ridiculous

  • @cellphoneunlocknet I agree with you, covers shouldn't be removed, but what I find funny is when people are surprised when they are removed and their channel does get suspended. However unnecessary the rule may be, it's there, and if you don't follow it things like this happen. Like I said before, he has no one but himself to blame.

  • Hey David...

You hit on a really really cool point...Imagine if someone could get the sync license thing figured out and partner with YouTube to make a library available of all the songs. Then people who wanted to cover them..would register and the publishers could then track it better. Might keep them happy and anyone covering would follow the same rules...Sounds pretty simple to me.

  • fuck google ever since they took over youtube it sucks ass

  • David, this is heartbreaking. There should be no reason that a person shouldn't be able to pay tribute to their favorite artists, and I have always thought it was wonderful that you introduced so many older songs to that shouldn't be forgotten. I think that what you're doing is inspiring. I hope you get your channel back and if not, continue to fight despite a lack of hope... As upset as you may be, please know that you're not the only one.

  • what happen to the old youtube 5 years ago??

  • Cheer up bro, I´m sure everything is going to be fine men.

  • It doesn't make sense.

You are doing COVERS, not posting the original song.

    There is a huge difference.

And just like you said, you post covers so we can hear new songs we've never heard before.

I hope you get your channel back. =[

  • hey, just to let u know, im totally on ur side!! stupid publishers r jzt jealous of ur talent, that's why they r making u stop. stupid copyright thingy; if those guys sell records, they were bound to be listened, and then, be singed! i jzt can't understand them. ganbatte! add oil! we'll support u! don't freak!

  • Wow David,

I'm shocked. This really sucks but you know what, You're gonna get it back. I'm sure you will. Esmee did! remember that? I'd love to know who the publisher is.

  • they sucked!

  • Playing guitar and singing along is alright in real life... Why can't people do covers? It's a recording of what people do in their lives. Are they going to destroy/kill all the guitars/people that have sang a song "THEY didn't want to get covered"?

  • DAVID I WANT TO CRYY!!! ur account is suspended i just found out today =((

  • Comment removed

  • thats total bs... youtube has no way of knowing what real talent is!! its ridiculous whats going on!! david has a lot of talent and i want to continue givin him support!!!

  • aww, david you sound so sad about it... hmm, your site could be another way to post ur vids if youtube and those record companies are being such jerks about it.

btw, it might be a good thing if you're actually getting the attention of major record companies, obviously they deem you as a threat to their own artists, cos YOU SING BETTER!

  • They should sell "sync" licensing just like they do mechanical licenses on Harry Fox. Like $100 for a million internet views. It funny though, if you get a mechanical license for a cover. I have seen many artists then monetized their covers on Youtube. Boyce Avenue does it even though I think Youtube made them take down some of their covers.

  • This is total garbage.. these labels should be exposed.. EMI and Warner Music Group?

These covers don't hurt you.. they make you and your neatly packaged singers famous..

They gotta understand that youtube is grassroots. This is REAL and what people want to see. People are getting tired of the fabricated and fake "artists" that are being marketed by these big labels. They want good authentic music performed by good authentic artists like David.

Youtube covers won't stop. Get with the times!

  • Comment removed

  • whats wrong in sharing covers ? u're singing in ur own voice not that u're posting the same content from some music company to ur channel... they wouldn't mind killing people if they could who sing their songs in lil concerts gigs and lil parties... what a shame really, and by posting a cover all u do is u give tribute to the singer and the song and yes u definitely introduce the song to people and in return the original song gets fame and maybe someone might buy the original song on itunes...

  • @hassanmah86 Well....WELCOME 2 MOTHER-EFFIN COPYRIGHTS!!!!

  • those companies are pissed off, cause David is promoting their songs for free? hmm weird

  • Hang in there. Hopefully this will work itself out.

  • It's all because of VEVO. Shame on Universal and Sony.

  • good luck on getting your old youtube account david !

we will always support you ! ( :

  • don't covers count as fair use?

  • praying

  • Come On! Give him back his account!!!

  • Some good and constructive thoughts. ... But I still think it's wrong that your channel gets taken down because of a cover song. I think the record companies are so damned scared because they haven't found a way to make money like they used to. But those days are over. And the record companies should do everything they can to catch up, instead of these ridiculous attempts to persecute all the wrong people. ... My two cents

  • Someone please PM me the studios that took David down. I'll upload 10terabytes of their studio releases.

  • and so once again, freedom of expression finds a new definition...

  • i hope you get your channel back...your music is so good

  • well, you already took down those vids, so what more do they want? those music companies don't own your channel, so they don't have the right to suspend your channel. All they can do is to ask you to take down the cover videos. You already took down those videos. Anyway, I really don't like those record companies that try to control other people. Hope you get your channel back.

  • I hope youtube won't suspend you account, it is ridiculous.

I used a MP3 that I paid and they deleted my video once because they think I am using an illegal music track...and yes, it was a Universal records song...

  • Seriously, what a bunch of bull these record labels are. I hope you get to keep your channel and continue making music!

  • i hope you get your channel back david!! really do!! you make good music, and if they have to suspend your account, they gotta suspend whole lotta accounts too, it's ridiculous!

  • I'm confused. Was it just that he did a cover, or did he use the MP3 in the backing?

Cause if its just the fact that he did a cover, why isn't Beiber in trouble for doing "With You" way back when? It's what made him famous. Or hundreds of other artists who do covers and get famous that way (Sam Hart, Zeldawhatever, etc.)

  • honestly, this is ridiculous

how does this hurt the companies? making them an extra buck?

i don't see the downside of this.

david, you do amazing things and i honestly think i speak or a majority of everyone here who believes that your account and all the others who have faced this issue should not be suspended, and let people express themselves.

COMPANAIES: stop letting greed over-rule your decisions and let creativity spread.

  • Damn all your videos with youtube celebs... Kevjumba, wongfu, etc.... Gone too!!! Why youtube!!!!!!

  • D: man...y must old ppl be like dat...i hope dey dun take ur channel down ur so awesome :D

  • I'm rooting for you David. I seriously am.

I've tweeted with both of my twitter accounts. I'm gonna make a small video as well to spread the word as well.

    Best of luck dude!

  • its stupid that these fatcat corporate greedy assholes are trying to take down people doing covers because, covers are never going to stop. theyre just one or two big companies and there are over 6 billion people on this planet. i say dont stop making covers because if one person gets suspended cuz of a cover, someones just gonna back him up and do the same cover. a neverending chain
