  • Really? I just need to know if there is anyway people can be sure that they won't be in any major trouble if they tried it.

  • There wouldn't be any trouble as such. The only party that would be entitled to seek prosecution is the injured party, which in this case would be your own sock account, so why would you sue yourself?

    Having said that, the only problem I can perceive is that all these false DMCAs will be handled by YT's own automated policies, and the staff won't even notice it, so I would say that participants should respond to their own DMCAs in writing forcing humans in YT to deal with it ;-)

  • No, but I got my ass covered from a legal perspective, that's all that counts there. The e-mail got sent, and I got a confirmation of receipt. I can legally assume that they bothered to read it.

  • Ah, I see. This actually makes it harder for YT to pay attention. Is there a possible way to break the automated policies? My guess is that all DMCA's go to a server that specifically handles them, but do we know the capacity limits of that server? You see where I'm getting at.

  • Here's the idea: rather than sending the DMCA claim by e-mail, send it by post. That means it has to be processed by a human being, and since it's a legal document they CANNOT ignore it. But, and this is important, ONLY include an e-mail address for them to contact you so you can remain anonymous. Then when your sock account receives the DMCA notification, respond by post again, so AGAIN someone needs to go through the hassle of processing your response.

  • Yup. I spoke out against filing a false DMCA against VFX. That should NOT be construed as a statement of support to him and what he does on this site. It's a statement against the abuse of sending a false DMCA. A false DMCA against VFX is just as immoral as one against anyone else. That's why I posted MY video about it. VFX, in the mean time, can go jump into his precious little lake of fire. XD

  • I know what your saying, I just don't agree to support him, in spite of my major dislike of false DMCAs.

  • Athiests are using waterloo tactics on flanders field, applying queensbery ruels to a bar brawl. Being less considerate and using the weapon of DMCA would either be ignored like theist DMCA and get rid of as many theists as they get rid of athiests, or it'd get youtube to finally act. Though the government will step in if this keeps happening (And wasting their time) and when that happens we don't want to be the ones false DMCAing!

  • Your first line confuses me, is it like local jargan? But everything else I agree with. But again, I think it's more on YT's part to act, and if the Gov. has to get involved, then there is a major problem with how things are run everywhere.

  • Shawn has two faces; PCS, the idiotic whipping boy of the youtube community, who's return was praised for all the ownage videos it'd fuel: and VFX, who less people remember, the guy who false DMCAd and stole from charity, who's not so loved.

    DMCA is a plague on this website. The leglislation needs to change, it's impossible to abide by it unless you either ban everyone without investigation or have a big enough organisation to investigate everyone. The Gov is being lied too and will act.

  • you hit the nail on the head that if we can even speculate on people DMCAing themselves just goes to show how open the system is to abuse.

    i doubt i could bring myself to try your suggestion about mass false filing as a way to get YT to pay attention, but at least you're think outside the box. i just hope we can solve it another way.

  • @gothatfunk I wasn't actually serious about the idea, I wouldn't even do it myself, but I can't see any other way to make YT pay attention. I just hope th petition works like planned.
