After the real kaien was killed, the hollow that was inside kaien took over his spirit. Rukia kills him kinda in a cheesy way, but yeah he's dead...they kinda lead that she's dead too but the manga hasn't followed up too much on that yet.(they probably wouldn't kill her off)
