  • Well gitmo is being closed and you have nothing more to worry about..except for the well being of the detainees when they hit general population. If they now have access to our federal courts and have the same protections as American citizens under the Constitution, what does this say to an American soldier who captures one of these terrorists on the battlefield and may still be being fired at in terms of collecting evidence, rights of the person that he's captured and all of these types of things?

    The problem is this. Bush has tried to characterized combatants picked up on the battle field as terrorist. Which is ridiculous if they are picked up on the battle field. They are conventionally referred to as POW's or prisoners of war. They are entitled to the rights of POW's as referred by the terms of the Geneva convention. However, Bush wants to torture them for some sadistic reason. So he labels them terrorist and brings them to Guantanamo. But has yet to convict anyone.

  • the JOB of the Supreme court is to interpret how the Constitution applies to US citizens.. these prisoners are not US citizens, therefore the Constitution (and the privilege it extends) does not apply to them.. what's f*cked up (in my mind) about this decision is that the current Supreme Court believes they have power now, over everyone in the world?.. I hope at some point we'll return to the Founding Fathers belief in a Constitution for Americans, we're not the Court of the World ~

    Read the Constitution you won't find a US Citizen requirement anywhere.

    This is also a ruling that Congress can not restrict the court from its fundamental in nature.

    One example was of a German Citizen who got kidnapped by Pakistan, sold to the US, tortured in Afiganistan, then found NOT to have any terror ties, then shipped still to Gitmo, remained there for 3-years until a US Law Professor and the German Chancellor got him out.

    Check 60-minutes for the story the aired several weeks ago.

    Give them POW status or give them Habeas Corpus. The vast majority of people held at Guantanamo have nothing to do with the terrorists. And it's wrong to hold people indefinitely without letting them know why they are being held.

    It's a right that goes back hundreds of years before our country existed. And it's worth quite a few American lives. I certainly don't think it will lead to the destruction of our country.

  • guantanamo is foreign soil. just as all our overseas military bases are on foreign soils. there is no constitutional right for non-citizens on foreign soil to receive habeas corpus and there's nothing in english common law that does either. the supreme court, in this decision, "invented" new law, never before practiced.

    using foreign soil in this issue is a sticky subject, because its a bit of a legal grey area. Gitmo is a US base and its location is not authorized by Cuba, but rather received via conflict, so its a territory or occupation. Either way if a child is born on a US base its considered still US soil. A US embassy is considered US soil. So the question then becomes is it US soil for a foreign prisoner held by a US official paid for by US tax dollars. The court held in the affirmative.

  • a legitimate argument. gitmo was aquired as a base by treaty with the pre castro government. but that doesn't negate the fact. as i stated over and over again. that the right of habeas corpus has never been applied to a non-citizen on foriegn soil. this includes foreign U.S. military bases. this is new law without any precedent.

    And its still a FUZZY area of the law to try and say that Gitmo is outside of the Constitution and outside of the Geneva Convention.

    Fuzzy lines historically have always come back with very negative consequences.

    Gitmo & Military Tribunals are NOT necessary. The Federal Court System is very capable in handling these types of cases.

    This Bush policy was trying to take a short cut nothing more.

  • a supreme court decision is indeed law. it does circumvent the legislative process but it is law nevertheless. it is also debatable whether the geneva convention applies in these cases. and i like to remind you this preccedent nullifies an agreement between bush and congress that allowed tribunals of the "detainees". so now a quick resolution of this dilemma is threatened.

    its not law, but whatever.

    The mistake the Bush Admin. & the GOP Congress did here was trying to create a quick fix outside of the law.

    What should have been done & will probaly occur from this ruling is incorporating these types of suspects into the Federal Criminal Law & to create the proper Crim. Proc.

    By doing this it only legitimizes our actions more & creates a fair process that protects those that may have been falsely accused.

    We need a longterm solution NOT a quick fix.

    Giving a branch of government too much power without checks & balances is far more dangerous.

    there are no guarantees in life and neither are there in law.

    The war on terror is flawed, because you can't fight a war against an unknown enemy. Same flaw that has plagued the war of drugs.

    War and military actions are only successful with specific enemies.

    Terrorism will never end, it has always existed and will always exist.

    The way you REDUCE terrorism is too truly change the perceptions the world has and to create real security not the joke we have today (ex. TSA).

  • US law clearly states that ANY US base IS considered US soil, even if it is in a foreign land...

    Why keep proving that one can not remove teh stupid...?

  • foreign bases are considered U.S. soil when there is an offence on that base and the offence is committed by a american citizen. if the offence is committed by a non-citizen in the employ of the military while on base the domestic laws of the host country applies.
