That's fucked up that they have unequal age of consent for sodomy, and to viewers, YES, it is discrimination against gays, at least indirectly. How? Because straight people can have vaginal sex, giving them the right to fuck in some way or another at 16. But gay men can only have anal sex, thus they don't have the right to fuck in any fashion until 18, thus they don't have an equal right for age. I know I didn't consider other forms of fucking, but that's the general idea.

On 3rd Feb 2010 retired Australian High Court Justice the Hon Michael Kirby issued a strong statement that Queensland has no justification in refusing to enact equal age of consent reform - especially when the rest of Australia and even India have already done so. If you're allowing indoctrinated guilt to make you feel that your homosexual attractions are sinful (rather than being God's good gift - just as for heterosexual attraction), then there are "ex-ex-gay" support groups that you can turn to for help.

Without getting into a discussion about race discrimination vs sexual preference discrimination, the age of consent regarding anal sex applies to men and women and to gay and straight people so it isn't discriminatory, except on an age basis. Age discrimination in the area of sexual consent is perfectly valid to protect children.

The higher age for anal sex in Queensland is amied squarely at same sex attracted male youth - precisely because it is very commonly considered (although quite in error) to be the definitition of "homosexual sex". This law actively discriminates against same sex male youth, not hetero youth, and ther's no logical basis for it. It does not rpotect youth in any way, but harms them by denying adequate support and acceptance as well as inclusion in relevant safe sex education. It fosters homophobia.

A lot of what you say is your opinion. If the law applies equally to straight and gay people it is not discriminatory. Same sex youth under 18 and who are at least 16 years of age can still sexual relations just not anal sex (as you have implied). The same goes for straight youth.

This is certainly not just my opinion. The official 1990 Qld Parliament Report's Recommendation 9 was "THE COMMITTEE RECOMMENDS THAT THE AGE OF CONSENT FOR HOMOSEXUAL ACTS IN ACCORDANCE WITH THE PRINCIPLES OF SEXUAL EQUALITY AND ANTI-DISCRIMINATION BE THE SAME FOR MALES AS IT IS FOR FEMALES, IRRESPECTIVE OF WHETHER THE SEXUAL ACT IS HETEROSEXUAL OR HOMOSEXUAL."

They wrote this because they knew that a higher age for anal sex would be equate in practice to a higher age for "homosexual sex".

Anyone with even a slim grasp of logic would have to agree that the clear purpose of the 1990 PCJC Recommendation 9 (as quoted above) was for a truly equal age of consent to apply to all persons, whether the person was doing homosexual (anal) or heterosexual (vaginal) intercourse. In Australia the voting age is 18. An "adult" under Criminal Law is 18 in all regions except Queensland (17). In Qld sex other than anal is legal at 16, anal sex (often read wrongly as "gay sex") is a crime until 18. In sll other states and territories the age of consent is truly equal for all youth at either 16 (Vic, NSW, WA, ACT, NT) or 17 (TAS, SA). Since 2003 Qld has been the only state without an equal age of consent.

Are there equal rights for gay people in the military. Here in the states we don't have equal rights for gay people in the military. I believe its wrong. I knew gay servicemen and women but they couldn't make it known or they'd be discharged. How is it there?

In addition to my other reply: The lagel age for drinking alcohol in public is 18 in all states and regions of Australia. The important point is that many young people do sex regardless of the law, but a higher minimum age denies them vital safe sex education, support and acceptance. Age appropriate sex educsation is proven to help delay first sexual experience (as well as increasing the likelihood of sexual activity being totally safe).

Sex ed. covers sex...doesn't really matter with whom your having sex with, the age of consent laws protect teachers and the school system from the backlash of parents...a line has to be drawn somewhere, sorry if it doesn't meet with your approval but that's life.

There is a clear problem with "Sex ed" as a hi school subject if it focuses only on male/female relationships and on penis/vagina sex (but not anal sex). 1 in 5 Australian youth (whether straight or gay) do anal sex. Students need to be told that anal sex without a condom is very high risk for HIV. 1 in 3 Australian youth do not use condoms for penetrative sex. Full honesty is needed for effective education. It is also vital that students be aware that it is perfectly OK to be gay.

The age of consent is not there to protect teachers or the school system - it is to protect youth themselves, and the only way that all youth can expect to be equally protected is if the same age of consent applies to all youth. Our government's own committee recommended a truly equal age of consent in 1990 - but to keep conservative members of parliament appeased they decided to set a higher age for anal sex - which they knew most ignorant people would presume to be "homosexual sex".

Queensland is the only place in the whole of Australia which does not have a truly equal age of consent. That inequity does not meet with my approval because it denies equal rights to young same sex attracted gay or bi male youth and it also leaves many heterosexual youth at unnecessarily high risk of HIV infection.
