Reports say that the knife wasn't even open when it was recovered from the scene. Eyewitnesses say that John Williams never actually turned to face Officer Birk, much less turned and assumed an attack position. The knife was a legal 3" long, and the cop was about 12 feet away, behind this man who was deaf in one ear. Forensics say he was just looking over his shoulder beginning to turn when the cop shot him. I heard 5 shots; four struck the man. The cop was too far away to feel under threat. My guess: he was angry because he'd given an ORDER and was being ignored. This was murder. If anyone with no badge had done this, he'd be convicted in a heartbeat.

i was "ordered" to go home by two officers in two cars post-questions. of course, i simply left the highway (no longer doing what they didn't want me to do) and continued my leisurely walk in a commercial area. who the fuck are they to tell a 19 year old man to "go home"? i have a curfew?
and by "down the highway" and "late at night" i mean the areas to the side that are easily walkable, at times like 2 AM where air quality is good/temp is on the colder side/there are VERY few cars on the road.

I usually am very sympathetic to Officers who have their actions questioned, but for this one I can't agree with the actions of the officer. Reports say that the knife wasn't even open when it was recovered from the scene. Eyewitnesses say that John Williams never actually turned to face Officer Birk, much less turned and assumed an attack position. When four seconds is all you give a man before shooting him in the back, you aren't trying to protect and serve.

Officers who do not perform their duty correctly make all and even good officers look bad, their duty is to de-escalate situations not worsen them. A gun is always the last and final choice, and when used a disarming or disabling shot is most necessary. This officer has no common sense. As a employee who works with police and parking(i am not an officer) i am ashamed of him. I am glad he has resigned. should he have gotten sentenced? Listening to his radio traffic, it is clear that Officer Birk knew that what he did was wrong. Firing five times is also not part of his training. Standard defensive response is two rounds center mass. Birk's actions are inexcusable upon further investigation of the situation.

If you showed to a scene and your colleague told you someone just tried to kill him, you would believe him too regardless of knowing what actually happened. As humans we are inclined to believe what our partners tell us. I am certain that upon learning what actually happened, the other officers did not agree with Birk.

Williams wasn't a raving lunatic high on meth, there wasn't return fire, there wasn't a group of hard types making threatening gestures, just a body lying on the cement. Yes, you would still approach with caution, but that circle jerk group of ten men in swat door breach formation approaching that body is fucking ridiculous.

However, once the party arrived and was within 10 feet of the body, it should have been clear to everyone that the threat was exaggerated. If a tactical posture of ten men is needed to assess a body, then the training is poor. The "they were only doing what they were trained to do" excuse doesn't help because it implies that none of these men are smart enough to think.
