there is actually a violation. kanye west's likeness is his intellectual property. when he poses for polo or hennessey (i forget if that's his endorsement deal or not, it may be some other company but you get the drift), he gets paid a royalty by the company for a spot in US magazine, etc. capturing his likeness then selling it without kanye's agreement or giving him royalty can be argued as intellectual property theft.
The photographer didn't "sell" anything, what are you talking about. That didn't even enter into this scenario, the dude snapped a picture and got assaulted. So there was NO violation of the law in his part. He was just a guy going through the airport, just like Kanye, saw him and snapped a photo. This all comes down to the camera men being ALLOWED BY LAW to take pictures as long as they're on public grounds. If they shoved a camera up to Kanye's house window and filmed, I think Kanye should be able to hit them in the mouth. But this was a PUBLIC place. there is actually a violation. kanye west's likeness is his intellectual property. when he poses for polo or hennessey (i forget if that's his endorsement deal or not, it may be some other company but you get the drift), he gets paid a royalty by the company for a spot in US magazine, etc. capturing his likeness then selling it without kanye's agreement or giving him royalty can be argued as intellectual property theft.

The photographer didn't "sell" anything, what are you talking about. That didn't even enter into this scenario, the dude snapped a picture and got assaulted. So there was NO violation of the law in his part. He was just a guy going through the airport, just like Kanye, saw him and snapped a photo.
