  • retards saying... if your parked at walmart drinking in your car, its private property and there is not a damn thing they can do about it! do you want to make a bet?? its called quasi public property meaning that you expect the same protection regardless of where you are. dont believe me... be a sketchy wonderer drinking/intoxicated in his car at walmart in front of a cop and see what happens...

    If you are going to debate LEGISLATION, which is not law over the people, you should actually read it. State codes have nothing to do with me as a member of the Republic and the people of the preamble.

  • Cops have 3 modes of engagement they must abide by.

    1. Communication

    2. Detainment

    3. Arrest

    He was communicating with you which means you were not obligated to talk to him, give him I.D. or cooperate in any way. If you were committing an infraction or a crime, he's now obligated to detain you and possibly arrest you. Fact is, he was completely ignorant of any legislation prohibiting you from staying in your car.

    He knows for fact?

    He's a liar and bordered on committing fraud.

    You can sue.

  • This "officer" obviously has what is called, "Wyatt Earp Syndrome." Larger police departments are on the look out for these kind of deranged persons prior to hiring, but smaller departments don't have the resources to adequately qualify, therefore, "gun touting cops," escape the proper interview. Hence, you have this officer trying to project his "authority" upon an innocent American Citizen without ANY knowledge of American Laws!

  • The laundramutt is correct. If you are parked on private property and drinking there's not a damn thing they can do about it. The Supreme Court has already ruled, if you're living in your trailer or RV, that is your home and the cops have no right what-so-ever to invade, inspect or question without a properly executed search warrant. You were on private Wal-mart property and the cops have no enforcement jurisdiction unless Wal-mart issues a complaint. Fire this cop before he kills someone!

  • I wonder how many people can actually count the number of borderline illegal questions the police officer asked. 1. You legally DO NOT have to produce I.D. but are only LEGALLY required to correctly identify yourself. 2. A passport is FEDERAL identification and is superior to any state issued ID. 3. If the person states their drivers license was lost or stolen while traveling, a simple computer check can verify the person's privilege to drive.

  • i wouldve handle it differently then that, i wouldve been in jail that night cause i dont deal to well with the police. i been to jail once. i was pulled over for no reason and he wanted me to step out the car. *long story*

  • There are a couple of site on the net that list Wal-Marts that do not allow overnight parking. You might seek this out since the policy is set by the store manager.

    Many of the stores in the west have banned the practice since people were camping there, extending slide outs, setting up grills and awnings, not just staying one night.

  • When a cop rolls up on a guy, he hasn't been watching six months of his youtube videos and knows he is benign. When a scruffy dude is sitting in a van in the dark part of a Wal-Mart, working the phone, he's a dealer or a vagrant, either of which can be trouble. Once he got a handle on you he backed down. The "you're telling me?" is a test to see if you are drunk or a problem.I'm surprised he didn't hassle you about your license. You explained yourself. He backed off. No problem.

  • Because the cop asked you if you drink I was wondering if a person could be charged with DUI in a wheelchair. Googled it and a man was passed out in his motorized wheelchair going full throtle down main street and they charged him with DUI and took his wheelchair from him.

  • Hey Jordan, I just searched around on google. Most walmarts will let cars and rvs stay overnight but you should ask the manager for permission. That doesnt mean thats what I would do, I would just do what you did, or better yet, since I drove a tractor trailer over the road for 10 years I'd most likely stay at a truck stop before a walmart. That said, fuck that cop. He was an asshole I wouldnt sweat it.
