  • The problem here, though, is that the Alabama Supreme Court actually upheld the law; like it's supposed to do! You may not like the ruling, but that's what a court is supposed to do! The law ought to be changed, but that's up to Alabamians to decide.

  • The problem here is that you believe the government has any power to ban sex toys and that the supreme court should not have overturned the ban as an unconstitutional restriction on the right to free speech.

It is not a federally unconstitutional infringment on speech because it's not Congress doing this. First word in the 1st Amendment is Congress.

  • That is entirely false. If you believe that the constitution only applies to bills passed by the US House of Representatives and US Senate then you have a lot to learn about American government.

  • @IFknHateUTube No, it's not. It's the reason Jim Crow laws were able to be passed and even upheld in Southern states. You have to bear in mind that the Constitution primarily limits the Federal government.  Did you know a state could establish a state religion? Several states did just that. The idea is that there are things the states are allowed to do that the Federal government is not permitted to do. Read the Federalist Papers.

  • Wrong. Under legal theory of the time Jim Crow laws were not unconstitutional. The doctrine of 'seperate but equal' was legitimized in Plessy vs Ferguson. The laws regarding the organization of elections have always been the realm of the states and poll requirements were not challenged as being racist.

    States may have had their own religion at the beginning of the country but they cannot anymore because of the ruling in Everson vs Board of Education in 1947.

  • They still can have their own state religion. The Supreme Court is not the final arbiter of what's constitutional, even though they sort of usurped that role in Marbury v. Madison. All I'm saying is that if the Constitution was interpreted properly, then yes the states can do things that the federal government isn't allowed to do (by virtue of the 9th and 10th Amendments). What is the first word in the 1st Amendment?
