@IFknHateUTube No, it's not. It's the reason Jim Crow laws were able to be passed and even upheld in Southern states. You have to bear in mind that the Constitution primarily limits the Federal government.  Did you know a state could establish a state religion? Several states did just that. The idea is that there are things the states are allowed to do that the Federal government is not permitted to do. Read the Federalist Papers.

Wrong. Under legal theory of the time Jim Crow laws were not unconstitutional. The doctrine of 'seperate but equal' was legitimized in Plessy vs Ferguson. The laws regarding the organization of elections have always been the realm of the states and poll requirements were not challenged as being racist.

States may have had their own religion at the beginning of the country but they cannot anymore because of the ruling in Everson vs Board of Education in 1947.

All I'm saying is that if the Constitution was interpreted properly, then yes the states can do things that the federal government isn't allowed to do (by virtue of the 9th and 10th Amendments).
