Sotomayor did not even order an examination of the test to discover whether or not there was cultural bias. to this day, it is entirely unknown whether or not the test had any cultural bias. the test was thrown out entirely on the false pretense that disparate test scores is proof of cultural bias in the test.
it can be an indication that the test was culturally biased. but it is hardly proof of such. there should have been an examination of the content of the test before making a ruling.
i believe that the promotion should be based on the merits to perform the job at hand, as determined by a completely neutral test of material relevent to the occupation of a firefighter.
i will concede that it is POSSIBLE that there was a cultural bias to the test that led the 18 firefighters and 2 hispanics to achieve the best scores.
However, the point i want to make is that just because two groups scores higher than another does not mean that there is a cultural bias in the test.
In an article on yahoo. I found out that 41whites passed, 22 Latinos passed and 19 blacks passed the test. Here is the tricky part: only 21 whites and 2 Latinos were promoted. No blacks at all and only 2 of the 22 latinos that passed got promotions. in order words the ratios are 50% whites promoted 10% latinos promoted and 0% blacks promoted amongst those that actually passed the test. Sotomayor is not the bad person. The real discrimination is apparent from the above numbers.

and as far as the disparate impact precedent goes, if you want to learn more about it, look up the case Griggs v. Duke power Co. this is where the term originated. However, there is a key difference betyween that case and this one. in griggs, the test that was administered was not a measure of qualifications relevant to the job, it was a mere IQ test and did not provide an indication of competancy that was specific to the job.

This guy passed the test and others didn't, so therefor he is more qualified as a firefighter than the others. That is something for the testers to decide, the court ruled correctly because it used a supreme court precedent. As the supreme court has since ruled differently a new precedent has been set and if another such case came before Sotomayor she would judge inline with the new ruling ie for Ricci.

Sotomayor did not even order an examination of the test to discover whether or not there was cultural bias. to this day, it is entirely unknown whether or not the test had any cultural bias. the test was thrown out entirely on the false pretense that disparate test scores is proof of cultural bias in the test.
it can be an indication that the test was culturally biased. but it is hardly proof of such. there should have been an examination of the content of the test before making a ruling.

i believe that the promotion should be based on the merits to perform the job at hand, as determined by a completely neutral test of material relevent to the occupation of a firefighter.
i will concede that it is POSSIBLE that there was a cultural bias to the test that led the 18 firefighters and 2 hispanics to achieve the best scores.
However, the point i want to make is that just because two groups scores higher than another does not mean that there is a cultural bias in the test.

In an article on yahoo. I found out that 41whites passed, 22 Latinos passed and 19 blacks passed the test. Here is the tricky part: only 21 whites and 2 Latinos were promoted. No blacks at all and only 2 of the 22 latinos that passed got promotions. in order words the ratios are 50% whites promoted 10% latinos promoted and 0% blacks promoted amongst those that actually passed the test. Sotomayor is not the bad person. The real discrimination is apparent from the above numbers.

and as far as the disparate impact precedent goes, if you want to learn more about it, look up the case Griggs v. Duke power Co. this is where the term originated. However, there is a key difference betyween that case and this one. in griggs, the test that was administered was not a measure of qualifications relevant to the job, it was a mere IQ test and did not provide an indication of competancy that was specific to the job.

the fact that he has been in so many litigation cases is entirely irrelevant, and i believe to argue that it is enrtirely belittles the american judiciary. would the litigants in the first two cases settle out of court if ricci's cases did not have some merit to it? of course not. there had to be some merit to ricci's claims that led the legal counsel to settle out of court. even if the fire department did lose the case, the costs would be covered by the city so court fees is not an issue.

This guy passed the test and others didn't, so therefor he is more qualified as a firefighter than the others. Race should be completely invisable if you are a republical, democrat, or nutjob; you should be able to agree with this. Other arguements are debatable while this test result is concrete. It is wrong to only let minorities receive the promotion, because then race is made an issue where is wasn't prior.

That is something for the testers to decide, the court ruled correctly because it used a supreme court precedent. As the supreme court has since ruled differently a new precedent has been set and if another such case came before Sotomayor she would judge inline with the new ruling ie for Ricci.

Hey 45gunner Wasn't Jesus a socialist? Jesus multiplied the loaves and fishes and spread the wealth amongst all who were listening to him. He tried to level the "health care" playing field by healing the sick -- and no one had to pay. He overturned the vendor tables in the temple and basically kicked the capitalists out. Of course! That's what sharing is all about so everyone, not just the rich, get care. In the US, government officials, including their spouses and dependents, receive excellent healthcare paid for by taxpayers up to 75% of the premium. Why not everyone? Why is it that the working class, at any time, can become medically bankrupt yet rich officials who can pay for themselves don't have to?

But what if I'm not for sharing? What if I want to take care of only myself and my family and no one else? I earned the money I made, therefore, I should decide who gets it. Of course thegovernment needs taxes, but the majoity should be mine to keep. And what gives the government the right to use my money to buy others healthcare? The poor don't have to worry about it, because they would recieve the care. The rich don't worry about it for obvious reasons. The middle class as always will pay.

A) raise your prices to cover the loss (everyone pays)
B) write it off on your taxes (again, everyone pays to compensate for the lost tax revenue) or
C) operate at a loss and go out of business.
D) turn the sick out to die.

Well I guess no one should have to pay taxes for any police or fire service to go to your house. You should have to take care of it yourself. Costs are lower when everyone shares the bill.

That quote is out of context, and completely loses what it means when you use it that way. I do believe it's ridiculous to throw out a test because a large portion of people failed it, and they happened to be minorities, but if you're going to discuss issues you have with people, give strong, structured evidence that they're wrong, instead of snatching up a popular misquote and using it as a point for an argument.
