Hospital emergency rooms are required by US federal law to give emergency care, but that only means you are guaranteed enough medical care to stabilize your condition and keep you alive. If you need an organ transplant or reconstructive surgery, you're out of luck unless you can pay for it.

If you want to eat yourself to death then you have every right to, but if you're smoking in public places then you're endangering the health of OTHERS. Your behavior is protected so long as it is not detrimental to others, because their right to protect their body is greater then your right to harm yours.
