Obama's point is that a case like that is one of the most important things they do and he supports judges that would choose this case. We don't know which ones actually did besides Ginsburg or what their final ruling is.

If the Supreme Court makes decisions based on the Constitution you don't need to worry about the encroachment by the Executive Branch.
