    If the Supreme Court makes decisions based on the Constitution you don't need to worry about the encroachment by the Executive Branch.

  • So if Obama is nuts why did the Supreme Court take that case seeing if the Judicial can personally check Executive cabinet members? The system didn't even render a verdict yet but obviously it is an issue they do worry about to hear the case.

  • As you point out the system took care of the situation. Are you just angry that Obama has selected the pastor as the person to give the invocation. The only people I have heard that objects is the gay community.

  • I don't care about which pastor does it. The system might take care of itself because the Supreme Court is considering ruling to "guard against the encroachment of the Executive Branch" in a case where the Constitution isn't specific. Obama's point is that a case like that is one of the most important things they do and he supports judges that would choose this case. We don't know which ones actually did besides Ginsburg or what their final ruling is.

    Then what are the limits of Presidential signing statements and judicial review? The Executive and the Judicial encroach on each other there with neither power specified in the Constiution. Obama seems to side with judicial review more than signing statements but the issue is far from nuts. It is unsolved and a huge debate.
