I have to side with the police because either way you shouldn't be struggling or causing problems in order to attract the police's attention anyway. From other angles it does look like the police office mistakenly discharged his gun when he meant to shot his tazer, which is easy to do in such a heated situation.

We would run the same drills over and over and over again. There is no excuse, I would never excuse this, but I do understand how it happened.

@Magic9053 You obviously have not done any research. The only witnesses who said that were friends of Oscar, were proven not to be there at all, or too drunk to have the slightest idea what they saw. Several of those taping the incident can be heard to be yelling "stop resisting". Several witnesses testified to his assault on officers and his clear resisting of arrest. I know it is hard for you to believe, but the FACTS are that Oscar Grant assaulted cops, refused commands, and resisted arrest.

@ssn708 I'm pretty sure the "taser" cover story didn't come out until a few days after the shooting had already taken place. What seems more likely to have happened is Mehserle pulled his gun wanting to intimidate a mouthy black kid, and maybe maybe accidentally discharged the weapon in his back. Either way there was no reason for a taser to be used on a compliant a subject in the prone position, and there was absolutely no reason for a firearm to be drawn what so ever, let alone fired.

I have to side with the police because either way you shouldn't be struggling or causing problems in order to attract the police's attention anyway. From other angles it does look like the police office mistakenly discharged his gun when he meant to shot his tazer, which is easy to do in such a heated situation.
The officer's actions are also not the fault of his family, stop threatening his family. It is sad that the poor guy died from the gun shot and I hope his family well.

We would run the same drills over and over and over again. Pretty much every single time someone would panic, and do something contrary to his training and common sense, with what would be fatal results in a real world scenario. There is no excuse, I would never excuse this, but I do understand how it happened.

The cops defense was that he accidently shot the guy because he thought he had his taser gun instead of his Glock. I almost believe him. Who could keep their head straight with all these loud ass black people acting like animals? Seriously, the cops were probably fearing for their lives, thinking any one of these violent blacks could have had a gun and attacked them. It was an honest mistake.

@NeighborKid Oscar Grant was the one shot. He was the third person from the right (the viewers right). The officer was brought to court. It was proven to have been an accidental shooting, he was convicted of involuntray manslaughter and sentenced to 2 years. I agree on the video, Karina Vargas (the one filming) was obviously too drunk to even keep the camera still, yet talks ( and testified) like she knows what was going on. She didn't even know where she was, much less what was happening.

I have seen every video of this, at no point did he cock his gun, or take any other action consistent with firing a gun. His actions, distance, demeanor, stance, angle, all prove he thought he was firing a taser and not a gun. His reaction is pretty telling as well. It is a FACT that he thought he pulled his taser and not his gun, as has happened to no less than 8 others before the Grant incident.

@Magic9053 The FACTS are that Oscar Grant assaulted a passenger on the train who went by the name of "Diesel", was identified as the assailant by passengers as well as the driver of the train, Grant assaulted 2 officers (Dominici and Pirone) and very clearly resisted arrest by trying to roll onto his back instead of laying on his stomach, refusing to give his hands, and placing one under his body near his waistband. Some of us actually have done our research. Maybe you should try it some time..

MOST of the suspects were White &Latino, You're right, you never heard about those, did you? It's tragic, and Meserle was criminally negligent and deserves prison time (as do the other 8 officers, in my opinion) but this was not a murder, it was not an execution, it was not racially motivated. A dumb panicky cop accidentally shot a violent career criminal who was resisting arrest.

Had he not resisted arrest (and yes, he most certainly WAS resisting) and simply allowed himself to be handcuffed as his friends did, this would not have happened. It does not excuse the shooting. Mehserle was criminally negligent and deserves prison time, but facts are facts. Grant assaulted someone on the train, assaulted 2 cops, and resisted arrest. Those things can lead to fatally bad consequences.

Grant WAS resisting arrest. Grant DID assault 2 cops. Pirone did NOT punch Grant. These are proven facts. Had Grant simply allowed himself to be handcuffed instead of resisting arrest, this tragic and criminally negligent accident would never have occurred. His friends complied, notice how they are alive?

Several of those taping the incident can be heard to be yelling "stop resisting". Several witnesses testified to his assault on officers and his clear resisting of arrest. I know it is hard for you to believe, but the FACTS are that Oscar Grant assaulted cops, refused commands, and resisted arrest.

If this was intentional, it means Mehserle did ALL of the following:
Yelled "I'm tasing him" to mask his intent.
Stood up to make sure dozens of people could see
Masked his actions to be 100% consistent with firing a taser and not a gun
Shot Grant in a completely NON-VITAL area of the back, calculating ricochet to pierce Grant's lung while not hitting himself or other officers
Faked a look of shock and horror
A man with a family and a future did all this to execute a complete stranger? Sure.

@ssn708 I'm pretty sure the "taser" cover story didn't come out until a few days after the shooting had already taken place. What seems more likely to have happened is Mehserle pulled his gun wanting to intimidate a mouthy black kid, and maybe maybe accidentally discharged the weapon in his back. Either way there was no reason for a taser to be used on a compliant a subject in the prone position, and there was absolutely no reason for a firearm to be drawn what so ever, let alone fired.

@KangOfYou No statement at all came out for a couple of days.Yes, there is plenty of reason to use a taser, because he was FAR from compliant, he was resisting after assaulting 2 officers prior and pulling his hands away and putting them under his body. Pretty much any cop is going to tase you at that point. If he intended to pull his gun, he would have unlatched the catch that keeps it in the holster, not tugged and tugged until it came loose. NO cop would draw with officers in the line of fire
