Federal law gives different tax brackets to married couples, disallowing certain couples to be married means they do not have access to those same tax brackets.
this is just one example, but it is a big one.
not to mention the protections for the division of assets accrued during the marriage should a separation occur.

when you deny the legal protections offered by a state recognized marriage, and decide that a certain group of people cannot have access to that marriage, even though they have just as much a justification for those protections, then yes that is unequal protection under the law.
Nobody needs the states permission to get married else nobody would skrew with it, its largely symbolic, but they want the protections!
