Only open 54 hours? Has the judge ever heard of preparation time before the customers walk in? How about cleaning up time? If they are open 54 hours over 7 days there's got to be at least another 7 to 14 hours of working time to prepare and to clean up.

OK, first of all he should've taken this case up with the Labor Board of whatever state he's from. The fact that he didn't shows me he probably didn't have a case to start with. But based on what I've seen if he completed training successfully and was working, then he should've been paid for training unless it was spelled out someplace in a contract, which even then may have been illegal. Judge Milyan has continuously disappointed me recently. I don't think she's capable of making judgments. She's the one that should get fired here and not paid.
She had the hots for him, but he wasn't going for it because he couldn't figure out if she was attractive or not because he kept getting blinded every time he looked at her. And so they found themselves all in court. That's my take on it.

There's nothing wrong for putting a period of training before you hire someone. Just make it clear and you must have a timeframe agreed. Sales jobs quite often have unpaid training for up to one week, but if you make sales during training you get 50% of a normal commission (your trainer gets the other 50%). So unpaid training isn't unprecedented.
I've managed restaurants for 15 years and always paid my trainees. Just saying.

WHAT? What does Milian mean "that can't be" re: working more hours than the restaurant is open. Doesn't she realize that ALL chefs work hours outside of serving hours. DUH. It's called prep work, cleaning and closing down the kitchen for the night, training, staff meetings, new menu preparation/learning, private events, etc. etc. etc. I've never heard of anybody working or training without pay. I have a small retail business and the "out of hours" work add up over a week, I can tell you. As for not paying staff, well, that's outrageous. A fair days pay for a fair days work. Nobody can live off thin air and nobody should take advatage of someone as the defendants did of the plaintiff

sounds like they just want things on the cheap......and i believe the chef was mistreated....bet they change chefs quite regularly,it just not sounding all that is it?she just using people...hopefully they end up out of business...and the judge not listening and has no idea how hard life can be with no money.

WHAT? What does Milian mean "that can't be" re: working more hours than the restaurant is open. Doesn't she realize that ALL chefs work hours outside of serving hours. DUH. It's called prep work, cleaning and closing down the kitchen for the night, training, staff meetings, new menu preparation/learning, private events, etc. etc. etc. I've never heard of anybody working or training without pay. In fact, as far as I know, it's ILLEGAL here in Canada. Is that really legal in the US?

@sauceykat You make a very valid point in your observations! No business open to the public can adhere to the "opening" hours, especially a restaurant with all the behind the scenes chores required. I have a small retail business and the "out of hours" work add up over a week, I can tell you. As for not paying staff, well, that's outrageous. A fair days pay for a fair days work. Nobody can live off thin air and nobody should take advatage of someone as the defendants did of the plaintiff

That would be seriously taking advantage of desperate people to say they have to do mandatory training without pay until you are satisfied enough with their work to work on their own. Believe me, there are plenty of businesses that use that scam (especially telemarketers and door2door where they call it training and then just stop calling you once they've got enough free work out of you.

Seriously what is on that waitress' face?!if it's glitter, WHY is it on her cheeks? wtf......I have considered jobs that had two weeks UNPAID training....I think that should be illegal..it's like total paranoia on the job..forces you to be a suck up and adds to the stress of bring new....all you would need is ONE person at the job who decides to give ya a hard time (and there's always some bad-seed wherever you work) and that's it , you're out.

This lady watched an episode of kitchen nightmares and thought that the cook was supposed to clean and maintain the whole kitchen. No one can cook and wash dishers. The cook is supposed to supervise and make sure that it is done. Bet that this bitch got rid of each cook just before their pay was do. This bitch took advantage of someone who was desperate and she thought would not fight back. If she paid him under the table as she said, he should be sure to report her to the IRS.

That restaurant doesn't seem very trustworthy. One staff member cleaning the kitchen, preparing the food, cooking the food and then washing the dishes? And they search for their chefs on Craigslist? On top of that, the waitress isn't even cute, she looks like she did her makeup in the dark.
