Scalia is full of it. Alexander Hamilton, whom he so deeply admires, did not allow any torture of British soldiers during the Revolutionary War. Scalia knows nothing, I'm ashamed he spoke at my high school graduation. How would he like it if he were arrested and tortured? Punish - "to suffer for offence". The detainees are made to suffer for the offence of not giving their torturers the information they want. A similar case would be a parent punishing their child for not telling the truth.
Yeah, the Constitution is vague about a lot of things, maybe because the Framers thought we would be capable of using our heads and didn't feel they should have to spell out D-E-C-E-N-C-Y for us in black and white, using small words and step-by-step instructions, in a tome as large as War and Peace. If the Constitution bars torture as a form of state-administered punishment after the intense scrutiny of the legal process has run its course, then of course it prohibits it in any other context.
The point in torture isn't supposed to be a punishment, it's a method of extracting information albeit brutally. Not that I'm condoning it, but you should really check your dictionary before spewing dialogue left right and centre :)
It's a legitimate argument: the fact of the matter is that language is not definite, and the Constitution is vague about a lot of things. What I want to know is why the reporter didn't argue that the officer is punishing you for not giving up the info.
