The gun was confiscated from Luthor (not explained in the movie). This fight took place AFTER the original Superman was supposedly killed by Doomsday. Luthor stole the corpse and made a clone from his DNA, so he could kill it as if it were the original. Superman turns out to be alive but weak, and is forced to face the clone before he could fully recover. That's why the "bad superman almost won"
