  • The old bait-and-switch. Like people aren't going to call him on it? I think JJ should have awarded the plaintiffs a lot more than $600, if for no other reason that to teach him a lesson and compensate for all the hassle, inconvenience and irritation they had to put up with.

  • @bg11215 But that would be based upon two assumptions (1) that the Plaintiffs are telling the whole truth and the Defendant telling zero truth; (2) that the Defendant has a history of deception. Neither of these things are accurate. The Defendant stated that all three buses were available when the Plaintiffs called, they were specifically told what kind of bus it was. The Plaintiffs were implying the trip was ruined and kids embarrassed, but that's an exaggeration. The $600 was fair.

    All 3 buses probably were available since there is no real reason to lie about that.

    But if the defendants specifically asked for the city bus or the bus in the flier or weren't specific since they assumed they were gonna get what they see is unknown.

    I can think that the kids were embarrassed and that it was ruined a bit since it was the "prom".

  • @rjh00 I agree with you that the Defendant was not as up front as he should have been and should not have represented all his buses as being the same. But at the same time I feel that the Plaintiffs were partly to blame here and were also guilty of exaggeration. Like the Judge said, the kids look like they had fun and it was the parents that were upset, not the kids. So personally I'd apportion the blame as 60% the Defendant and 40% the Plaintiff.

    1) Of course he's going to say that. He knows that it will make the plaintiff appear irresponsible in court.

    2) They are suing him because they didn't get the nicer bus, which DOESN'T have a stripperpole.. If they wanted a stripperpole, why would they order a bus that doesn't have one? You can see the pictures of inside the bus from his site that there are no poles..

  • Spoiled mommies and daddies raise spoiled kids. I'll be this couple sues any company who doesn't give them the luxury they feel they deserve. When they called the transportation company all three buses were available, but that one was what she chose and was informed specifically. She had the responsibility to look at it before committing rather than taking someone's word. I don't think the Defendant did anything wrong, other than to suggest on his website that all his buses were the same.

  • As much as I can't stand how parents spoil their kids with limos, cells, etc, I think JJ should have awarded these people the full amount. JJ agrees that it was not the bus they agreed to. If the plaintiff had known in advance, she may have chosen a different company altogether. It was obviously an important event for her. She had no choice if he arrived at the last minute and she had 60 kids waiting. And just cuz the kids had a good attitude about it, doesn't mean she should pay for it.

  • I am not totally satisfied with the judgement, the plaintif had the time to look at the bus before the bus left she could have said something then. I believe the kids are spoiled kids and because they are so spoiled, they went back home and complained to their parents. I also must say that the flyer was not that close to reality.

I was expressing my distaste for Proms, and since Japan doesn't have formal high school dances, I'll never have to deal with Prom dresses, tuxedos, or things like this case's silly party bus. (Over here, when you attend a wedding or funeral, your school uniform is considered formal wear until you graduate.) To answer your other question, people are generally very honest in business
