I think in this one, all are too blame. It was a series of misunderstandings between all of them: the different flight controllers, the controllers and the crew and the pilot and co-pilot. Had they all stated things as they were (extremely bad weather, no more fuel, emergency) none of this would have happened.
But the first officer never declared an emergency ... he never said the magic word "Mayday" despite the captain asking him to say it over and over again. Maybe it was the first officer's relative inexperience, but it was a fatal mistake.
@Juank0120 This plane was 23 years old at the time of crash so had it not crashed it would have been withdrawn from service anyway, because Avianca received its first B-767's in 1990.
I cannot believe this! I really cannot believe that ATC and the pilots of that plane let this happen. What a waste. Some accidents are tragic but unavoidable or unforseeable, this accident is all the more tragic because it was completely preventable. I am very sad about this.
the first officer could be blamed for not saying emergency but to me that is understandable. English is not his first language and is probably not the language he speaks at home. Where he lives and grew up saying priority was probably how you say i need attention. its just habits and misunderstanding

Aircraft, for all they have lifejackets, are not designed for water landings. Which is stupid but understandable. With such little fuel, a belly landing becomes a possibility, but it's too built-up an area. Given they were on dangerously low fuel near Norfolk, there is one civilian airport there and at least one military. Those would be dangerous landings. For the civilian airport, they'd have to do deliberately what the Boeing did at Heathrow when all power failed.

Yep. If the engines were not mounted underneath the wings they may of stood a chance ditching in the water. They would of pretty much acted like scoops if they tried (which was demonstrated in the ethiopian airlines hijacking) and disintergrate the plane.

As with all disasters, it isn't the individual failures that matter, it is the cascade of failures that makes disaster inevitable.
