Bialek claimed that she was unduly touched, but she never pursued her claim after the alleged incident occured and then 14 years later says something. Besides she has a reputation as a gold-digger. In other words there really is no story here. Cain denied that he sexually harassed these women. Well, the claims are dirty innuendo and gestures. That's it? Sorry, but that isn't sexual harassment as there is no clear threat, no abuse of power nor undue physical contact. It's all a big joke.

Herman Cains campaign claimed that the source for this attack is the Perry campaign, so take that up with him. 3rd. Where did I right that Cain is "Guilty" of any wrong doing in this matter. I didn't say that Cain didn't accuse Perry of anything. I referred to the allegations only which are BS as they are at best gestures and remarks. Cain has been consistent in saying that he didn't sexually harass and frankly the public has yawned over it as there really isn't a story here. This story proves nothing. It's a joke.

He claims that there was no sexual advances made, but we won't know what the other side of the story is until the two women break their non-disclosure agreements. We will know soon enough.

    Look at the history so far. His poll numbers have not wavered til they fell insignificantly recently with Cain's gain in the polls as this non-story unravels.

    Romney's number has been virtually 25% since the start. No more, no less. The other candidates trade supporters but Romney has already aggregated all the supporters he will ever see. 3/4 of the registered R voters want someone else.

He will still be there when Herman Cain's accuser comes out and makes her statement. Make no mistake, this is nothing like the Justice Thomas smear. Cain's accuser was paid off for her complaint which gives it some legitimacy. Cain and his campaign manager have botched this up, which sheds light on Cain's personnel judgment.

We knew what the accusations were: stupid remarks and talk of porn films. & we know what the evidence was: nothing. There was a non-disclosure agreement made when the two females were paid off by the American Restaurant Association settled with them over their sexual harassement suits naming Cain. Since Cain has commented on the two cases the women now feel they have the right to comment as well and their attorneys are fighting for that. This is for real and their will be a book deal to follow their press conferences. This is no fairy tale.

They know that once they make the claim the company must respond and will either fight it costing lots of money or decide to settle generally costing much less then fighting it, they can't ignore it. The laws favors those who make these types of claims and rewards them. These employees need to come out and explain what happened or its all just BULLSHIT.

  • @Lombokstrait1 Wrong. There is cost to consider. It is often far less costly in terms of the cost of the judicial process and the lost opportunity being far more than an out of court settlement. Paying the accusers off may be a much cheaper route, so that is why it is taken. It has nothing to do w/ liable vs not liable or guilty vs not guilty. It's about cost.

    The point is that an out of court settlement proves nothing regarding culpability as it may pertain to cost. There were out of court settlements here and they prove nothing regarding culpability. Besides remarks and gestures aren't an abuse of power.

Answer: Frequently the former, so it is better from a business standpoint to go to the former of the out of court settlement. Here is a lesson in business: Opportunity cost. When going to the judicial process of $100Ks or $millions, that is money that could have been used for expanding or maintaining the business rather than deal w/the courts.

    We should also have cameras everywhere except in bathrooms and microphones as well. That way alll conversations and interactions can be recorded to ensure whether or not sexual harassment took place.

    All the parties concerned have non-disclosure of the facts of the incident as part of the agreement.

    The woman, only one person got a settlement payout, is under contractual agreement to say nothing specific about the settlement. Agreements such as this are contracts with specific terms of expected actions and behaviour by signatories.

    The other two are subject to public ridicule for making baseless claims. I don't see them crawling out of the woodwork any time soon.

    The Courts tend to protect the gov that employs them and have no problem denying basic civil rights to members of the Press irregardless of the explicit protections outlined in the US Constitution.

    They haven't actually said anything yet.

    All Politico reported is that there appears to have been claims of harassment made regarding behaviour exhibited by Herman Cain when he was the Chairman of the Nat Restaurant Assoc. They made no specific claim and so haven't actually libeled or slandered Cain, yet.

    That's why this isn't a story or controversy. No one has said anything of substance.

  • @maskedphrogg they made an allegation suggesting that Cain had sexually assaulted two women, that is all it take to damage a reputation in this day and age. it should be considered libel if it is not true! if they can produce no evidence that their claim is true they should be sued for libel.

  • @337noname Often times it is cheaper to settle out of court then to go to court, many settlement cases have confidentiality agreement so he might not be legally allowed to talk about the case details. given that he is a republican I'm more inclined to believe that this is a witch hunt like the justice Clarence Tomas case. and not a true allegation like the Clinton Affairs and the Lewinsky cum stained dress or John Edwards cheating on his cancer stricken wife now their are some real douche bags.

    There have been no substantive accusations made.

    Herman Cain was not a party to the payouts made to two women who allegedly made some unspecified accusations that were directed at Cain. As a man of integrity he turned the matter over to other members of the Board and it's legal team. He recognized his obvious conflict of interest. Though Chairman at the time he was properly not a party to the eventual resolutions.

    You don't know any more than we do.

    Fact - Cain was accuse by two different people of sexual harassment. Fact - both charges of sexual harassment had enough merit to bring a settlement which Cain signed off on. Fact - Cain at first denied it, then admitted it. Fact - the last fact shows a real lack of integrity by Cain.

    Wrong. That is what happened. NRA has disclosed some information. No one has disclosed any substance of what accusations were made. Politico created innuendo that the accusations were in some way related to charges of sexual harassment, but no one as yet has stepped forward to confirm or give any details about the charges. Cain and the women who made charges are bound by legal agreements to not disclose these details. So it's obvious you are making hay with no straw at hand.
