this is where u'll go astray. u cant say "u dont have to be alim to know this" this is not that simple of a thing 2 just say " was there makrooh/sunnat e muakiddah at the time of the prophet (saws)? Then anything that they say today that is makrooh or sunnat e muakkidah, take all these things out of islam because the prophet (saws) would tell us not to keep such terms." Prophet(saws) said, "The superiority of an a'lim over an a'bid (worshipper) is like my superiority over the lowest among you."

"and who are hanafi and shafi anyway to decide makrooh or haram" and then u go on and say listen to zakir naik? .. this Dr. Ali doesnt have sufficient knowledge in Qur'an, Hadith and Fiqh and their sciences and neither does Zakir Naik. He has an MBBS and then he did dawah work man. He didn't become qualified at all to start giving fatwas and all. This is what happens to people who study a little bit and people praise them and they start issuing fataawa about every aspect of islam.

So don't mistake it. HAR koi mufti hain, bas zara sa deen ka zikr aaye bolne lagte aisi baat. Bahut ehtiyaat ki zaroorat hoti moo kholne mein, deen ke maamile mein.

''A person won't be punished for doing it, but he'll be rewarded for leaving it out.''(Raddul muhtaar 6/337, Bahishti zewar 11/4, At tauqeef 673) ''It is better to leave it out'' (At ta'reefaat) ''It is that which is better to leave out than do, and this is also the meaning of khilaaf aula ..... If the proof is not a clear prohibition but only a mere suggestion it's makrooh tanzeehi.''(Raddul muhtaar 1/132)
A person would need sufficient knowledge in Qur'an, hadith and fiqh including their sciences to be able to decide whether a particular act is haraam or makrooh. Which obviously this man doesn't have and he's just using his mind.. " I believe that.." Islam doesn't work like that. If he is Shaf, then i can understand, but if he is hanafi... he doesn't know a damn thing and he's just using what HE FEELS...
the question still remains ......did our beloved prophet has ever used the term makrooh .... and who r hanafi and shafi anyway to decide makrooh or haram....i will suggest u listen to zakir naik...is suicide makrooh or haram..it is now a proven fact that smoking leads to death ...i believe dr ali has used the term on this basis..wallahu alam
aslamoalikum brother "aLiWswe" when it is said in quran not to harm your body then it means that "not to harm your body in anyway possible" which includes smoking too,and of course its not said in quran exactly or used wordings "no smoking" but see in the holy quran there are rules described for the best of not just muslims but to all the mankind.anyway my main point was that its simple anything which relates to harming your body is haram and the rest Allah knows best.
