It would absolutely be copyright infringement. Wrestlers only carry over names if they use their real names or if they are very careful with their contracts. Look what Vince did to the Dudleys...they had to change their name to Team 3D. They kept their name going from ECW to WWF because WWF acquired ECW and the contracts. Same thing happened when WWF bought WCW.

Therefore, it will never be referred to as nWo while on TNA, unless Vince buys them too.

When Giant joined the nWo it ruined the concept. When you think about it Razor and Diesel were known for being WWF guys and Hogan made his name in the WWF so it made sense when they were together to takeover WCW because it seemed like a plan that WWF put together dating back to 94 when Hogan went to WCW. Well it wasn't the fact that they had pretty much half the planet in the nWo, the strength in numbers really hit. Problem was, WCW didn't know when to stop with the angle. the nWo was cool, but fans were sick and tired of it. They should've ended it when Hogan lost the WCW Title to Sting, but the match was horrible. They completely overkilled the nWo till they finally decided to break it up. But it was still one of the greatest stables ever.
