@renalovsmy10 um...banks don't foreclose on a house if you're still making payments. This guy has already filed for bankruptcy which means he couldn't afford to pay his bills. Banks sell their debt all the time and during the housing bubble debt was sold without properly transferring the paperwork thus the buyers of that debt are having problems foreclosing. It's still legal, they just have to go back and get the paperwork done correctly so it's not unfair or unjust, it's just a technical delay.
My neighbours had their mortage rate go up and saw their monthly payment increase by an added $400.00 per month within a month of her losing her job. They begged Bank of America to reduce the rate to the original monthly rate. The bank said no way and forclosed on them. The house has been sitting vacant now for almost a whole year, dead lawns and all, because the housing market here took a major nose dive. They haven't even bothered to get a real estate listing for it!

It's possible this man could have made the payments on the business loan from the money he made doing business before the economy took a nosedive BECAUSE of the banks, Wall Street, and the other greedy, self-serving entities that caused this collapse. Also possible many of the other people being foreclosed on could have made their payments if they hadn't lost their jobs for the same reason. I don't see anybody coming in to bail any of them out.

Either way, he was obviously in default and owed back payments, that includes the collateral on his business too (which he must be back on too). He basically just screwed himself. He just tore down a house he still will have to owe on. Just because you're foreclosed on doesn't mean you're rid of the debt you paid.

@renalovsmy10 um...banks don't foreclose on a house if you're still making payments. This guy has already filed for bankruptcy which means he couldn't afford to pay his bills. Banks sell their debt all the time and during the housing bubble debt was sold without properly transferring the paperwork thus the buyers of that debt are having problems foreclosing. It's still legal, they just have to go back and get the paperwork done correctly so it's not unfair or unjust, it's just a technical delay.

They begged Bank of America to reduce the rate to the original monthly rate. The bank said no way and forclosed on them. The house has been sitting vacant now for almost a whole year, dead lawns and all, because the housing market here took a major nose dive. They haven't even bothered to get a real estate listing for it!

The bank had what's called force placed insurance because he wasn't paying for it.
