It was made in regards to warrantless physical searches for foreign intelligence purposes, not illegal wiretapping that by passes the FISA court, which is the case now pending before the Senate. Also, FISA specifically allows for exception to its requirements when "authorized by statute," and the Authorization for Use of Military Force (AUMF), passed by Congress after September 11, constitutes just such a statute.
