    Three sections of the Patriot Act that stay in force will:

    _Authorize court-approved roving wiretaps that permit surveillance on multiple phones.

    _Allow court-approved seizure of records and property in anti-terrorism operations.

    _Permit surveillance against a so-called lone wolf, a non-U.S. citizen engaged in terrorism who may not be part of a recognized terrorist group.

    Under FISA, requests for counterintelligence warrants are funneled through the Justice Department, which reviews applications by the CIA as well as other agencies before submitting them to the FISA court. 50 U.S.C. §§ 1804(a), 1822(a)(1) (1994). Each application to the FISA court must first be personally approved by the Attorney General. See 50 U.S.C. § 1804(a).

    No problem with the quote other than it is irrelevant. It was made in regards to warrantless physical searches for foreign intelligence purposes, not illegal wiretapping that by passes the FISA court, which is the case now pending before the Senate. They are mutually exclusive. Each application to the FISA court is already personally approved by the Attorney General regardless. FISA has been the law since 1978. Bush broke it. That is a crime. That makes him a criminal.

  • It appears that the two of you disagree with the opinion from the FISA Court itself. A November 2002 decision of the FISA Court of Review stated that "the President did have inherent authority to conduct warrantless searches to obtain foreign intelligence information. Also, FISA specifically allows for exception to its requirements when "authorized by statute," and the Authorization for Use of Military Force (AUMF), passed by Congress after September 11, constitutes just such a statute.
