Fraud and Theft are completely different offences. The point is how you construct being guilty of the offence. Part of it is the guilty act (actus reus). These MPs seem to have done this. But you also need the guilty mind (mens rea), otherwise there is no crime (eg. if A slaps B on the back in jest, and B dies of a sudden heart attack, A has committed the act but there's no intent). So, we do not know how many of the MPs were intentionally dishonest, or just incompetent. There is a difference.

No, I am afraid that you don't understand the law. The test for fraud and/or theft is whether the action was done dishonestly - and that is both a subjective and objective test. See the case R v Ghosh which is still binding law. If a person genuinely made a mistake, or did not even know what they were doing was dishonest, then it is NOT a crime. That issue is a question of fact for a jury to determine. You have to follow the rule of law on this, you can't just treat MPs differently out of anger
Well, it doesn't quite work like that. Just because an allegation is made doesn't mean that the MP should face trial. The CPS have to look at the evidence obtained by the police and decide if there is a realistic prospect of a succesful conviction and whether it is in the public interest. Once that test has been satisfied, then they will be charged and committed for trial. In fact, this is what is happening right now - the CPS are reviewing the evidence. It will take some time.
I think that most people accept that there is evidence of dishonesty. But CPS are between a rock and a hard place. Especially where political infuence is concerned.

That said, you may be perfectly right in that, once the evidence comes to light in more detail (and if the MPs were cross-examined about it) then it may be that some were acting dishonestly in which case they will be prosecuted, and there's no doubt about that - the executive has no influence over the judiciary, hence the separation of powers. The CPS are already looking into it. But it may be that some honest mistakes were made - in which case no crime has been committed. We need more info.
Again, better to use our legal system to try these people. Some of the allegations made are serious and outrage the majority of the public. Many think that they, personaly, would be imprisoned for similar acts. The only way to go is for these people to be put on trial by the Courts.
And, I think that as MP's are supposed to be 'honourable' and 'trusted' (shining lights), then if found guilty, they ought to automatically receive the maximum jail time without parole.

Absolutely, the sentencing guidelines take into account any aggravating factors such as a breach of trust etc. But we can't have show trials where we make examples of individuals to get rid of our anger - we must treat them as any individual would be treated objectively in the same position. But the number of actual fraud cases is pretty low, it seems most were just exploiting the system - and this may not be dishonest (no matter how immoral) because they knew it was permitted at the time.
Again, better for CPS to gather evidence and take individuals to Court. Nobody can guess the extent of fraud until this happens. But, as public servants in the highest office, then all found guilty must be dealt with harshly.
Though the CPS have not yet taken cases forwrard, I feel that they/others must have a good idea who might face prosecution.

Fraud and Theft are completely different offences. The point is how you construct being guilty of the offence. Part of it is the guilty act (actus reus). These MPs seem to have done this. But you also need the guilty mind (mens rea), otherwise there is no crime (eg. if A slaps B on the back in jest, and B dies of a sudden heart attack, A has committed the act but there's no intent). So, we do not know how many of the MPs were intentionally dishonest, or just incompetent. There is a difference.

Of the rest, there are clear moral differences between someone who interpreted the rules to get a new mirror for £50 (against the spirit of the rules but not unlawful) and someone who has claimed for a mortgage that didn't exist). No, I am not naive and I fully understand the issues. The point is that you can only send someone to jail for breaking the law and for commiting a crime that was crime at the date it happened. Therefore, it is quite right to break down the different levels of severity. You can't imprison someone for acting within rules, even if those rules are themselves unfair. As for te effect on public opinion, i fully understand it. But the mob isn't always intelligent enough to see the different issues

In these cases, then - if found guilty - they must get the maximum jail time for this.

No, I am afraid that you don't understand the law. The test for fraud and/or theft is whether the action was done dishonestly - and that is both a subjective and objective test. See the case R v Ghosh which is still binding law. If a person genuinely made a mistake, or did not even know what they were doing was dishonest, then it is NOT a crime. That issue is a question of fact for a jury to determine. You have to follow the rule of law on this, you can't just treat MPs differently out of anger

Well, it doesn't quite work like that. Just because an allegation is made doesn't mean that the MP should face trial. The CPS have to look at the evidence obtained by the police and decide if there is a realistic prospect of a succesful conviction and whether it is in the public interest. Once that test has been satisfied, then they will be charged and committed for trial. In fact, this is what is happening right now - the CPS are reviewing the evidence. It will take some time.

The onus is on the CPS to prove beyond all reasonable doubt that he is lying and that he beleived he was being dishonest. That only comes from detailed questioning and probing. As for your point re. judges, it is a jury that tries the defendant, not the judge, and judges are entirely separate from MPs, unless you have any evidence?

That said, you may be perfectly right in that, once the evidence comes to light in more detail (and if the MPs were cross-examined about it) then it may be that some were acting dishonestly in which case they will be prosecuted, and there's no doubt about that - the executive has no influence over the judiciary, hence the separation of powers. The CPS are already looking into it. But it may be that some honest mistakes were made - in which case no crime has been committed. We need more info.

Absolutely, the sentencing guidelines take into account any aggravating factors such as a breach of trust etc. But we can't have show trials where we make examples of individuals to get rid of our anger - we must treat them as any individual would be treated objectively in the same position. But the number of actual fraud cases is pretty low, it seems most were just exploiting the system - and this may not be dishonest (no matter how immoral) because they knew it was permitted at the time.

Again, better for CPS to gather evidence and take individuals to Court. Nobody can guess the extent of fraud until this happens. But, as public servants in the highest office, then all found guilty must be dealt with harshly.

I'm confused ... MP's keep telling me that extreme anti-terror laws, ID cards, National Integrated Databases and so forth are not to be worried about if I've got nothing to hide.
