The proper course would have been for the Cop to ask politely. If the man refused & the video was absolutely necessary to the investigation (which it wasn't, given the dash cams) then he could have submitted a proper warrant to a Judge to allow to seize the phone for a Forensic Copy of the video to be made & the phone to be returned to the man. But until that happens, he can't be held for Obstruction, if he politely refused the request (without the warrant), considering there was no emergency

The man being placed under arrest for video taping on his cell phone was given a warning to go back inside. However, the police officer that approached the house and placed the man under arrest had no reason to do so. This will most likely never see court time and it will be dropped immediately. The cop trespassing on their property with no reasonable cause was at fault and violation of constitutional rights. Shame on this officer for what he did.

As far as the home invasion comment, I don't wait 15 minutes for police to respond to my 911 calls when my house is being invaded. In about a second, I reach for my gun on my hip, draw, and shoot to stop the threat. 911 is for removing the body.

The people held at gunpoint were innocent. "Mistaken identity". The only person guilty of a crime (home invasion, ironically) in this video was the cop. He has no warrant, no probable cause, and no permission to enter that guys garage.
