woudlnt peer to peer encyption stop this? ie: if even the supernode's wouldnt know the filenames/data in plain text. then its all just giberish traffic, nothing to track even if they do assume a traffic hotspot to be a supernode.
They might not be able to target the downloaders but the guy that uploads is can be caught easily. No uploaders, no downloaders. If this is released a new infrastructure has to be built. I also believe that this may be illegal in some countries as what they are doing is considered a privacy violation.
