Hi guys, this might be a stupid question, but could they sue that company for discrimination? (PLEASE bear in mind I live in Australia and know nothing of US Law)
While i am all for gun ownership and open carry, i do have a little problem with openly carrying a gun into a store. The reason for that being that i work in a mom and pop liquor store often by myself and it would be a bit scary to have someone walk in with a gun. I do however, keep my Beretta 96A1 loaded with hammer down under the counter in case of emergencies. Also, i am well aware that a criminal would more than likely conceal a gun until he was too close for me to do anything about it.

You may be allowed to open carry but you must respect the rights and rules on other peoples property. If they say no carry on our property then you can't carry. The 2nd amendmaent gives us the right to own firearms. It does not give us the right to ignore others right's. Be a responsible gun owner and not a problem gun owner. And I am an NRA certified instructor and I teach that in my class.

@nickg2393 You should be worried about the guns you CAN'T see. The people Open Carrying know the laws, know how to use a firearm responsibly, and usually practice with their firearm often. Criminals are afraid to open carry their weapon because they don't know the laws, and the extra attention from police that you get would be unwanted, and questioning from other citizens would be harsh. This is why I open carry everywhere I go. Remember, fear can be rational AND irrational.
If a shop, store or restaurant has a sign forbidding open-carry patrons and you enter then you can be arrested for criminal trespass. If there is NO sign and you enter then you can't be arrested if the cops are called but will be escorted off the premises by the arriving cops or security. Also carrying a weapon in your car is legally dodgy altho in PLAINE SIGHT on the dash-board in most friendly open-carry states is o.k. Its best to check the local bye-laws well b4 leaving home with ur weapon.
All these people open carrying to get police attention is stupid. A gun is for self defense not for causing trouble everywere you go. Not the brightest to open carry if your comming off as a young immature adult. Doesnt go to well.

I am a strong supporter of OC but on Private Property it is up to the discretion of the Owner whether you can carry a gun into his store or onto his property.

Well, property rights are more important to people here in NH. When banks and stores get robbed here in NH, can you blame someone for saying, "please don't bring a firearm into my establishment"? It's their right because it's their property. Why are you disrespecting someone else's property? In NH, we are fairly free, but we also live by this one motto: "Live Free or Die", which really means: "DONT FUCK WITH US, FLATLANDERS!!!"
I am all for the right to own and carry a weapon. But, I also respect property rights. If a business doesn't want people to carry on their premises then that is their right. They just will get less business then.
I don't get why this guy thinks the store should be boycotted. As a manager of a store he has the right to ask that guns not be in his store just as he can ask anyone who is not wearing shoe or a shirt to not enter. This store in private property not a pubic place. I think as a reasonable person you could understanding someone being uneasy with someone bring a gun in their store. I think maybe the manger could have asked them to leave the gun out side instead of call the police and wasting taxes
@frankiegmh It is completely understandable, and proper that private business be allowed to make such decisions. Fear of guns is offensive to me in the same way fear of dogs is offensive to me. I am a law enforcement officer that supports open carry, but when you say "apparently they didn't have anything else to do today", you make yourself and your (our) cause sound stupid.
They did have other things to do today, but they got called by the clerks. Almost every PD in the country has a mandatory response policy.
If they didn't, they wouldn't show up every time somebody called in a dog barking or when your house alarm falses for the tenth time in a week.

I firmly support all forms of unlicensed carry, but on private property it is (or should be) up to the owners or those in rightful control of the property to decide who is and isn't allowed to carry firearms on that property. I would not be up in arms about someone asking me to leave because I was carrying, though I would likely take my business elsewhere. So, kudos the OCers for respecting the rights of the property owners and simply shopping elsewhere, I suppose.

No one is taking away the gun. Just verification that the person carrying is allowed to by law. That's why it is called law enforcement. The short detention to verify the carrier is allowed to do so by law is a small price to pay to make sure the carrier is allowed to have open carry. If people don't want the intrusion don;t carry. You cannot expect an officer to turn a blind eye to someone armed in public.
@walts44 Not In Pennsylvania, if you are CC you must tell an officer only if he asks if you are armed. In PA. open carry alone is not a reason to stop a citizen per court rulings.
@1239lvm. Well all I can tell you is every state is different. Here in Ohio, you must advise or be arrested. To me it seems like a reasonable thing to tell an officer. I have no problem with either CC or OC. Officer safety is important. Being asked or questioned keeps everyone safer. Big deal if you are asked. If you are legal you walk away from the encounter with your weapon.

My question is how do you determin if the person openly carrying is allowed to have a gun? Convicted felons are not allowed to carry. How do you determine if the person is allowed to carry if he/she is not checked?
@walts44 The answer: How do the cops "know" that every driver they see is licensed to drive a car? They don't. How do you know every person you see is not an escaped convict or a foreign spy? You don't. Part of -freedom- is that the fact that bad guys exist, does not mean good guys should have to be "checked" without cause. they should just add a sign to their entrance notifying the public that its forbidden on their premises. The only issue I could have with open carry is that it infuses a firearm into a location and in rare instances, that gun owner could be jumped, over powered and his weapon fall into the hands of a person or persons who are intent on committing a crime with it immediately upon taking control of it.

hey bud i did a ride along with some cops and we were going to a break in call it took us 6-8 minutes to get there when we got there the officer said to me look i had my lights and sirens on and see how long it took us and then he said we cant always get to the place in 30 seconds people don't under stand that they need protection. every thing was all good that cop was trying his hardest to get to the place we reached speed of 115 mph some cops are nice and some are assholes

That's true, but they are not held liable if someone is shot on their property due to their prohibition of firearms. Therefore we have lots of potential hunting grounds for criminals because of this lack of any liability for disarming law abiding people. So I refuse to go anywhere that I can't be armed.

Refusing someone service because they aren't breaking the law, or doing any actions that are detrimental to your business itself, is ridiculous.

yep. one of the few restrictions of OC here in new mexico is exactly that.
I know here in MN it's common to see businesses have signs posted to say no firearms allowed, (I know my local mall has signs posted). Of course that came up mostly after conceal and carry started.
OC or C&C, as long as it's legal, they should have to specifically post a sign about it. Just like it's legal to be shirtless or shoeless, but the store can tell you to get out if don't follow those.

@fluhlej There is no open carry in public in Texas that I'm aware of (you can on your own land, or while hunting), and we do have Concealed Carry, but it's licensed, you have to take a course, get a background check, etc... Texas has reciprocal agreements with most other CC states.
My experience with law enforcement is that they badly want to take 'reports' over the phone. You have to really argue with them to see any actual faces.

i'm all for open carrying but the guys that do it with an ak or just walk up and down the street then get upset when a cop shows up and says "i dont care if people don't like it" one thing is it being your right, another is abusing it by being a total dick... now do you really need to open carry in crowded places...... especially if they have never ever been an incident in there.... it's com on sense be courteous and throw your shirt over it for the love of god....

Well, property rights are more important to people here in NH. When banks and stores get robbed here in NH, can you blame someone for saying, "please don't bring a firearm into my establishment"? It's their right because it's their property. Why are you disrespecting someone else's property? I don't get why this guy thinks the store should be boycotted. As a manager of a store he has the right to ask that guns not be in his store just as he can ask anyone who is not wearing shoe or a shirt to not enter. This store in private property not a pubic place. I think as a reasonable person you could understanding someone being uneasy with someone bring a gun in their store. I think maybe the manger could have asked them to leave the gun out side instead of call the police and wasting taxes

I am a law enforcement officer that supports open carry, but when you say "apparently they didn't have anything else to do today", you make yourself and your (our) cause sound stupid.
They did have other things to do today, but they got called by the clerks. Almost every PD in the country has a mandatory response policy.
If they didn't, they wouldn't show up every time somebody called in a dog barking or when your house alarm falses for the tenth time in a week.

I firmly support all forms of unlicensed carry, but on private property it is (or should be) up to the owners or those in rightful control of the property to decide who is and isn't allowed to carry firearms on that property. I would not be up in arms about someone asking me to leave because I was carrying, though I would likely take my business elsewhere. So, kudos the OCers for respecting the rights of the property owners and simply shopping elsewhere, I suppose.

No one is taking away the gun. Just verification that the person carrying is allowed to by law. That's why it is called law enforcement. The short detention to verify the carrier is allowed to do so by law is a small price to pay to make sure the carrier is allowed to have open carry. If people don't want the intrusion don;t carry. You cannot expect an officer to turn a blind eye to someone armed in public.

@1239lvm. Well all I can tell you is every state is different. Here in Ohio, you must advise or be arrested. To me it seems like a reasonable thing to tell an officer. I have no problem with either CC or OC. Officer safety is important. Being asked or questioned keeps everyone safer. Big deal if you are asked. If you are legal you walk away from the encounter with your weapon.

@Dominicmetal. The answer is they don't know. That is why there is no expectaion of privacy when you are driving a motor vehicle. That is why it is ok for cops to run any license plate they see and check to see if the driver is valid or the car is stolen.
Comparing walking around with a gun has nothing to do with skin color or religious beliefs. Just because you have the right to carry does not mean law enforcement doesn't have the right to question.

@walts44 The answer: How do the cops "know" that every driver they see is licensed to drive a car? They don't. How do you know every person you see is not an escaped convict or a foreign spy? You don't. Part of -freedom- is that the fact that bad guys exist, does not mean good guys should have to be "checked" without cause. And the mere fact that guns are "scary" to some people is not sufficient cause, just like someone's religion, skin color, etc, is not sufficient cause.

they should just add a sign to their entrance notifying the public that its forbidden on their premises. The only issue I could have with open carry is that it infuses a firearm into a location and in rare instances, that gun owner could be jumped, over powered and his weapon fall into the hands of a person or persons who are intent on committing a crime with it immediately upon taking control of it.

hey bud i did a ride along with some cops and we were going to a break in call it took us 6-8 minutes to get there when we got there the officer said to me look i had my lights and sirens on and see how long it took us and then he said we cant always get to the place in 30 seconds people don't under stand that they need protection. every thing was all good that cop was trying his hardest to get to the place we reached speed of 115 mph some cops are nice and some are assholes

That's true, but they are not held liable if someone is shot on their property due to their prohibition of firearms. Therefore we have lots of potential hunting grounds for criminals because of this lack of any liability for disarming law abiding people. So I refuse to go anywhere that I can't be armed.

Take note robbers, shoplifters, and other degenerates!! The customers in the Stop and Shop on the corner of Valley and Wilson are COMPLETELY UNARMED. Store management ensures no one will be there to return fire or defend the Sheeple. I guess the store is a Gun Free Zone, and we all know how well those work (Virginia Tech, Columbine, etc). I think I'm going to write someone in the ranks of Stop and Shop a letter about this, and how they lost my business over it, I proudly open carry.

Refusing someone service because they aren't breaking the law, or doing any actions that are detrimental to your business itself, is ridiculous.

I know here in MN it's common to see businesses have signs posted to say no firearms allowed, (I know my local mall has signs posted). Of course that came up mostly after conceal and carry started.
OC or C&C, as long as it's legal, they should have to specifically post a sign about it. Just like it's legal to be shirtless or shoeless, but the store can tell you to get out if don't follow those.

@fluhlej There is no open carry in public in Texas that I'm aware of (you can on your own land, or while hunting), and we do have Concealed Carry, but it's licensed, you have to take a course, get a background check, etc... Texas has reciprocal agreements with most other CC states.
