It's the job of the prosecutor to seek justice, regardless of where that leads. When a prosecutor is seeking to convict someone even after it becomes clear that a conviction is at odds with the job of seeking justice, that prosecutor is willfully engaging in the act of trying to destroy another human being's life. That act is no less wrong than the act of a violent offender or a thief and should be punished as such.
Shouldn't the ACCUSER and his family come forward and pay a formal APOLOGY to this innocent man most likely convicted based on the color of his skin? Hello?.... Where is the acucser's & family's decency? Don't they now want justice and find the real perpetrator? How about an apology to his mother for starters?
He's a victim too, he was raped, COACHed, and led to believe (all these years), the perp was in prison. For all of us that have addressed the monetary issue, EXACTLY how many years of Prison (not jail or a holding cell mind you) are you WILLING to perform for a similar settlement? Remember most of those later deemed innocent spent their 20s-40s-50s ages in prison. Bear in mind (from what I've heard and read fortunately) Prison isn't some Resort like Escobar built for himself or where we send White Collar Crooks sometimes. I disagree (a little) on the "some ole",... summary. If you do a Weekend in a Holding Cell because you wouldn't let a policeman search your car and you're goaded and then arrested, that's BS. Perhaps A PRIMARY function of our justice system is to spend their time/resources on pursuing convictions as opposed to pursuing justice? As to the pursuing convictions vs. pursuing justice issue, I'm not sure if that was meant in seriousness or not, but I WILL point out that our justice system has been reduced to a shouting-contest of lawyers. How many guilty people have gotten free because their lawyer could suppress a key piece of evidence, claiming it was "prejudicial".

@EPGAH He isn't getting money for a wrongful conviction, he is getting money for having 35 years of his life taken from him by the state. That deserves substantial financial reparation. He was advocated for by the Innocence Project, not Jesse Jackson. Hell, Elin Woods is getting at least $50 million for hurt feelings in a divorce settlement. $1.75 mil for 35 lost years is a pittance in comparison.
Divorce settlements have always been too generous, because when one partner is rich, the natural inclination is either to punish them, or reward the other.
Unless you're trying to cast the taxpayers as the "rich partners", it's only barely relevant. Even so, the lesson is basically, "It's easy to be generous with someone else's money!"
Depending on the circumstances but basically, I ACTUALLY agree with you on Divorce Settlements. But I also think some of the REasons: 1. To Discourage divorce. 2. How years prior, men (mostly) were able to just leave their former families/spouses high and dry. Even after the Woman spent years Helping him build his career while she managed the household? IOWs the laws were an overeaction or can be an overeaction?
These Draconian divorce laws don't just discourage divorce, they discourage marriage period.
Worse, they bred a sort of meta-gold-digging attitude toward marriage on the part of the women, in that she can marry someone, have a couple kids for extra sympathy, THEN divorce him for money that she didn't earn.

Well actually, the state of Florida agreed a few years ago that they will pay 50,000 for every year that the released convict spent behind bars. This includes EVERY released con that has been proven innocent. I don't think North Carolina has any law pertaining to that. The Duke incident was very unfortunate, but none of these kids spent 35 years in jail.

Look up the name Arvin McGee. Florida didn't produce the 50k per year compensation law out of good will, they just didn't want to pay more than 1m per year IF they get sued by the ex-con and found guilty.

A Redding Police Investigator by the name of Tracy Hall soon took over the case for the boys. I am so happy for Mr Bain! I cant even imagine what happened to him while he was in jail for these past 35 years. The crime they said he committed doesnt do well with other inmates. That's only one of the so many stories like that. People are sleeping, watching TV or even at 2000 miles from the crime, and they're picked up, and put to jail for years. It can happen to ANYONE, no matter what race you are, how rich or poor you are.

He was a child, there's NO telling what the Justice system said/coached,... but don't get me wrong he's a part of the process that put an innocent man in prison for years but I don't hold him nearly as accountable as to those that were in the very system that was SUPPOSED to pursue justice.

For all of us that have addressed the monetary issue, EXACTLY how many years of Prison (not jail or a holding cell mind you) are you WILLING to perform for a similar settlement? Remember most of those later deemed innocent spent their 20s-40s-50s ages in prison. Bear in mind (from what I've heard and read fortunately) Prison isn't some Resort like Escobar built for himself or where we send White Collar Crooks sometimes. Perhaps A PRIMARY function of our justice system is to spend their time/resources on pursuing convictions as opposed to pursuing justice? Look at how many times he, his lawyers,.. tried to address his innocence? As to the pursuing convictions vs. pursuing justice issue, I'm not sure if that was meant in seriousness or not, but I WILL point out that our justice system has been reduced to a shouting-contest of lawyers. How many guilty people have gotten free because their lawyer could suppress a key piece of evidence, claiming it was "prejudicial".
All evidence is "prejudicial", it either proves you did the crime, or didn't do the crime!

He was advocated for by the Innocence Project, not Jesse Jackson. Hell, Elin Woods is getting at least $50 million for hurt feelings in a divorce settlement. $1.75 mil for 35 lost years is a pittance in comparison.

How years prior, men (mostly) were able to just leave their former families/spouses high and dry. Even after the Woman spent years Helping him build his career while she managed the household? These Draconian divorce laws don't just discourage divorce, they discourage marriage period.
Worse, they bred a sort of meta-gold-digging attitude toward marriage on the part of the women, in that she can marry someone, have a couple kids for extra sympathy, THEN divorce him for money that she didn't earn.

Well actually, the state of Florida agreed a few years ago that they will pay 50,000 for every year that the released convict spent behind bars. This includes EVERY released con that has been proven innocent. I don't think North Carolina has any law pertaining to that. The Duke incident was very unfortunate, but none of these kids spent 35 years in jail.

The two alleged victims a twelve and fourteen year old brothers reported to the police that nothing happened between them and the suspect Almeda. A Redding Police Investigator by the name of Tracy Hall soon took over the case for the boys. Hall soon manipulated and changed the victims alleged statements making it look like Almeda had molested the twelve year old.

He's not bitter because he's won the lottery.
Why should he be entitled to compensation, and none of the other falsely imprisoned--Or worse, do ALL the falsely imprisoned suddenly get a taxpayer jackpot?

You know what, if I break your TV, guess who's entitled to pay you back? The same goes for the state. No state are above the law, they are entitled to pay him back, and rightfully so! That taxpayer money that you speak of wouldn't have had to be used if they had made the correct decision in the first place!

So you're saying the corrupt prosecutors, crime labs, policeman, false witnesses, juries, judges,... are performing some kind of OutReach Program to imprison unsuspecting Americans, imprison them for XXX years, away from familiy/friends/freedom, as some Lottery Favor? What are the qualifications for this lottery you speak of, and why is this lottery not VOLUNTARY? Or maybe to you those folks aren't even corrupt but Benevolent Christians?

No, I'm saying other people have been acquitted once new evidence comes to life. Why should this one get money for it?
Today's paper even said that a criminal who was caught after 26 years on the lam got out on bail. History repeats itself, so I bet he'll "disappear" again!
If people get convicted, they have to be punished, otherwise our law becomes even more of a joke than it already is!
I will point out, though, that we're sliding from individual merit society to "uplifting the pathetic"!

he's doing his attorney, their walking out of the court room hand to hand, and you can tell by the vibe when there sitting next to each other, who cam blaim him shes a pretty white women, and he probably never had sex with a women, espicially since he's been incarcerated since he was 19

My gosh, I can't imagine what it would be like to have 35 years of my life stolen by the justice system. How this man can not be bitter is beyond me. I really hope he gets some quality living into his life! All the best to him.

I am so happy for Mr Bain! I cant even imagine what happened to him while he was in jail for these past 35 years. The crime they said he committed doesnt do well with other inmates. So God Bless this man. He DESERVES to be free. I hope the best for him and his family. Merry Christmas James Bain. And have a VERY HAPPY NEW YEAR!!! :)

Wauw how nice to hear and see that justice has been done for this man. What a strong caracter he must have to own no anger in his heart after being sentenced for 35 years! I hope all blessings will be with him now and that he can live life now!
And let we learn to make no differences between people, colour of the skin, race, background and all. Let's see this as a lesson also for us to forgive and look to eachother with no judgements.

That's only one of the so many stories like that. People are sleeping, watching TV or even at 2000 miles from the crime, and they're picked up, and put to jail for years. It can happen to ANYONE, no matter what race you are, how rich or poor you are.

Seriously, that KID was a victim too, twice even. He WAS Coached by the corrupt law enforcement elements involved. That kid had more coaching Bobby Knight, Joe Paterno, and Bowden combined. What's so cruely IRONIC, a Child Rapist was still on the loose as the folks that RRoaded Bain were celebrating and getting promotions.

How tragic! A man goes to prison for 35 years for a crime he didn't commit. This scares me.
However, the fact that the judicial system admitted they were wrong renews my faith in the system.
There is no amount of money ($1.75 million is what he is receiving) that can replace that time. I hope that he will be able to make the most of the time he has left.

He doesn't have to work... New house new car. BBQ grilling in the backyard... 54 years old is a long way to go baby... I wish his family and him and all his relative a get together and wish he can live the ripe old age of 90 to 100.... As well as other innocent inmate or people... If I were him man i will cry

ahd what world are you living in, white is still all right and has it's advantages (lighter sentences for same crimes, etc.) and let's not forget that whites do a "[high] percentage" of white collar crimes, serial killings, arson, look at your history, granted blacks do allot of crime,s the media chooses to glorify them moreso than crimes commited by whites!

They were raped, pissed on, burned, cut, and ripped to shreds before being stuffed into a can. If they had been black it would have made world news and jessie jackson would have been on hand.
