I live about 45 minutes away from Oakland and this story is everywhere right now. What's really unfortunate about this situation (besides a death and the loss of a normal life for the cop, whose wife just had a baby) is how the citizens of Oakland are reacting to it. Obviously they have a right to be upset, but there have been two "protests" now that have basically become riots. People are smashing windows of shops and cars that belong to people that have nothing to do with the Bart Police.

dude let me point out how he did not think he was using his taser. he had the gun point at the kids head. when you have a gun pointed to someone's head and is looking at the head like he is you can see vivid details of what differentiates a gun and a taser. and after he shot him and found out i wasn't a taser he would have looked at the taser cleasrly and be like WTF wrong weapon! but know the cop put the gun in the HOLSTER with like no hesitation whatsoever

The police man shouldn't have shot the gun. I think he should be arrested and proecuted, but not for first degree murder as you say. In California, to commit murder 1, it has to be willful, deliberate, AND premeditated. I don't think it was willful, as I don't think he would shot to kill him, also, i don't really think it was premeditated. He obviously was in a lot of stress and could have easily made a mistake and not thought this out well at all. Regardless, the officer needs to be arrested.
