(which he is a part) has "no evidence" that Awlaki was an enemy combatant or even a member of Al-Qaeda. So lacking evidence how can he draw the conclusion that killing an otherwise innocent man is a "net-positive"?

The reference to the 1940's Supreme Court case is annoying because FDR had already threatened to pack the court with his poltroons so the justices started caving to FDR's demands for socialist interpretations of the constitution. The SCOTUS disgraced itself and has never recovered. We the people can read the constitution for ourselves and make our own decisions, i.e. nullification.
Dr. Paul has gotten much more confident + assertive when addressing accusatory questions like this, which is great - he swatted them down beautifully, all the while maintaining a completely reasonable and likable tone. I give credit to Kelly too - Though I think her questions/points were intrinsically flawed, as other commenters have noted, her tone and demeanor were respectful & I actually got the feeling she was personally sincere in her questions and impressed with Dr. Paul's responses.
