First of all, you are calling the majority of the district court, majority of the 2nd Circuit Court of appeals and four Supreme Court Justices racists because they thought the other way on this case. Just to be clear.
Second, this case was about whether Title VII allowed for a presumption of discrimination when testing resulted in a racial disparity. Title VII and precedent said that it does. SC came up with a new rule, which was right, but it was close.

She made a racist remark but it seems like more of a slip-up. I know a lot of people who have a great deal of racial pride and occasionally they have slip-ups like that but when it comes to other races and cultures they have no problem with them.

Furthermore, who keeps perpetuating the rubbish that white people somehow get preferential treatment? Are people forgetting what real discrimination is? Real discrimination is not using offensive slurs to describe people, it is when a country mandates that race is going to play a role in who gets preference -- thus affecting peoples' ability to excel. Affirmative action is proof of unfair discrimination, but against the new white minority.

The whole premise of her statement was that since she believes (falsely) that latinos are an oppressed minority that she'd be able to come to a decision which could empathize better than a white man. Problem is, justice is supposed to be completely neutral and unprejudiced. By her statement she's already expressing sympathy for a certain race over another to influence her judgment.

I have never heard the word racist so much in one video comment. I for one do not care if some one is racist in their personal life what they think under their own roof is one thing. But to bring it into the supreme court is another. I know this is not supposed to be funny but if you look everywhere else its there. Look at Chris rock for example. It's sad that racism exists in a world without race, racism is just another idea that has been distorted to fit the convenience of white conservative males. But I understand what Satomayor is saying, EVERYONE is at least in part ruled by their perspective in this world, the reason the supreme court is as it is, is because the members to now have all been straight and white (with a minority of women). But it's okay that their views are skewed based on their color and sexuality.

Feel free to read the case, this was entirely about whether New Haven had the right to refuse to certify. Your problem is with Title VII, passed by Congress, and other judicial precedent.

For the third time, I thought the Supreme Court was right to overturn the appellate court in Ricci. That said, this was a close question and all your histrionics doesn't change that fact. Your problem is with Title VII and prior court precedent.

You still can't admit she's a racist. Her decision stands as the only evidence necessary to come to this conclusion. Legal precedent used for case interpretation should not be confused with the fact that Sotomayor's interpretation of Title VII is strictly non Constitutional in the context of Equal Protection under the Law. Everyone gets that benefit, not just non Whites, yet she punished the high scorer. The further you get away from this concept the more delusional your argument gets.

First of all, you are calling the majority of the district court, majority of the 2nd Circuit Court of appeals and four Supreme Court Justices racists because they thought the other way on this case. Just to be clear.
Second, this case was about whether Title VII allowed for a presumption of discrimination when testing resulted in a racial disparity. Title VII and precedent said that it does. SC came up with a new rule, which was right, but it was close.
