  • The claim from the firefighters was racial in nature, her decision wasn't. It will be hard for you to understand. A truly inferior being can justify thinking of himself as superior because of his race.  People who need to use their race, nationality, religion, ethnicity, sexual orientation, sex..etc, to feel good about themselves are losers. They have no accomplishments. Have you traveled outside our country? How often do you read a book? Where you raised in a small town in the south?

  • Unexceptional. Let's see. Second in her class at PRINCETON. Editor of the YALE LAW REVIEW. 17 years on the bench more than any other current justice had coming in. Did it ever occur to u that a lot of judges are what u call "bullies on the bench" and her critics may be those who she has ruled against or had disagreements with ? It probably didn't because I don't think that I'm talking to a scholar here. Princeton, Yale, 17 years on the bench. Yeah, unexceptional.

  • I also find it telling the TPM cuts off the rest of the interview. Had TPM had the guts to show Sotomayor's actual comments, it would be ABSOLUTELY clear that she is a racist and a sexist. Anyone who is not an hispanic woman is beneath her.

    A judge's sex, race, ethnicity, economic background, personality...etc..., affects the way they interpret the law. Our constitution is not the book of 'objectivity.'

    A conservative white male judge will tend to vote against liberal matters. A latin woman will more likely vote in favor. Judges are not 100% objective

(And please dont call me a racist because I have no problem telling you that I know MANY intelligent Blacks & Hispanics...many, many) But the fact of THAT matter is, Every person who did pass& qualify for thier promotion was White & everyone who failed was Black or Hispanic, & she would not allow the White people to recieved what they studied for, worked for & earned, b'cus no Black or Hispanic person did.   • I followed the case very closely because I was studying civil law. I think you are just looking at the overall picture. To begin - I think 19 white and 1 hispanic firefighters passed the test. The fact that you tell me they were all white tells me you are not even informed. I do not recall if any hispanics failed the test, I thought they were all black.

    You also need to know about affirmative action and the process followed by the city to eliminate the test. She did not rule alone.

  • Those are the rules of the game. Rupublicans nominate conservative judges, and democrats moninate the liberals. Because a judge's opinions affect how they interpret the constitution, a nonimation always makes the losing team cry. If you don't ilke it, move to Texas - I heard the governor there is trying to secede from the union.

  • Empathy does not make good judicial decisions. The late-great Oliver Wendell Holmes said that for the sake of the law and rationality, he many times had to decide against those who he felt empathy for.

    Had he not gone against his empathies, we'd still likely have Jim Crow.

    You have to ask yourself; empathy for who?

  • If u took the time to look at her rulings in the past like a lot of law scholars have, u would see that like those who have studied her described her, she is a moderate. But like most on the right facts don't really matter

  • Sotomayor's legal opinions were overturned by the US Supreme Court 60% of the time.

    Those that studied her must be sexist bigot racists, like her.

    This is the 21st century, not the 16th century.

    Liberals need to be forced to live in the 21st century.

  • She's been overruled 3 times in a decade on the bench. The SC has heard appeals on her 5 times. That's your 60%, but you overlook the fact that the average overturn rate for the SC is 65-75%. She's written more than 300 opinions. Her actual reversal rate is less than 1%.

    And merely being overturned doesn't make a judge good or bad. Alito and Scalia were overturned on 100% of their opinions heard on appeal by the SC!

  • I don't want to get into the identity politics here, because it seems to quickly get ugly, and because I'm sure your mind is already made up. Frankly, that's a matter of opinion.

    But reversal rates are matters of fact. And as you see, Sotomayor is not overturned 60% of the time; and frankly, reversal rates are not important in determining the quality of a judge. That's my only point.

    1. At least you're not talking about reversal rates anymore. Hopefully that's because you see that I was right.

    2. Isn't it a bigoted statement on your part to say that the only place a particular judge would be fit to be a judge is in Puerto Rico? That there's something so horrible about Puerto Ricans that you think they'd deserve her, but no one else?

    Take the beam out of your own eye before complaining about the speck in the other person's eye.

  • I suggested Sotomayor be a judge in Puerto Rico because she can only discriminate against men and non-Puerto Ricans there.

    It would reduce the number of injustices!

    I'm as concerned about Sotomayor being reversed by a higher court, as I'm concerned about some of her bigoted remarks explaining her judgments.

    Sotomayor has no place in any legal system!

  • She's been an excellent 2nd Cir. judge for over a decade and her judgments on matters relating to race are much more even handed than you think. I'd point you towards Norville v. Staten Island, in which a discrimination claim brought by a black employee was dismissed and Cruz v. Coach Stores, in which she dismissed a Hispanic woman's work discrimination claim.

    Your view of Sotomayor as some sort of racist who summarily judges against whites without cause is totally false.

    I'll assume, Sotomayor made these racist, sexist bigoted remarks to a group of racist Puerto Ricans (La Raza) for a speaking fee.

    This tells me Sotomayor can be bribed as a Judge and has no problem making a decision based on skin color or genitals.

  • Well, I read "empathy" from Obama as possibly referring to someone who enables bigger government and the welfare state while on the bench. Not someone that thinks (rightly) that the gov't had a huge hand in causing the financial crisis. Rather, someone who "feels" for the middle class by blaming the rich all the time and scapegoating them 100%. Claiming the poor are poor simply because the rich "screwed them over." Or someone who's a friend to ACORN on the bench.

    Empathy is the capability to share your feelings and understand another's emotion and feelings. It is often characterized as the ability to "put oneself into another's shoes," or in some way experience what the other person is feeling.

    How is that a bad thing for a justice to have?
