Simple enough. The music is created by a circle. That circle has the full rights to control how their work is to be sold, distributed and used according to the copyright laws of Japan. It is their work, as such, they say what goes and what doesn't.

The fact that it is doujinshi doesn't matter at all. It is just some dumbass excuse some people use to justify getting stuff for free. They fall under the same copyright laws as anything else.

Fair use in Japan is much different from fair use in America. Americans (youtube) have to abide to their laws if the piece in question is of Japanese origin.

Since ZUN already gave all rights to his fans, it doesn't matter if the remix is official or not.

They can. Even if it is a remix of an official Touhou work, the creator of said remix still has full authorship over it. Just because ZUN chose not to control his creation doesn't mean the other doujinshi artists did.

The rights ZUN has given to me as a fan is the rights to use his creation to make my own adaption. The circle that made this remix; Aqua Style, is a doujinshi circle that makes profit from adapting ZUN's work. This remix is sold by them. I am definitely not allowed to fully distribute nor publish someone else's profit maker.

Anyboduy who was asking about the vampire increase in race thing, they actually explain during Remilia's introduction. Remilia is a "Light Eater" who isn't able to drain people to the point of turning since she gets full. Flandre I am not sure of though, since she was trapped in the lower parts of the mansion for 495 years.
