yeah he got the man and not the ball and took em straight down, strict rules would say clear the penalty but the referee has the discretion be (a) a dumbass and (b) to say, ehh, it wasn't a clear goal scoring opportunity - he couldn't really shoot with his next touch and any player he was going to pass the ball off to wasn't going to score directly either, surely they had a little bit of an advantage they got the cross in and Henry had a shot deflected- CORNER, but aye it's a penalty.
