But also, I mean the reason why they are set up is to try and catch illegal immigrants and if they happen to come up on illegal drugs and firearms that also fits the discription. Incidental discovery of illegal drugs or firearms is one thing but purposefully using a limited scope immigration checkpoint as a pretext to actively look for such things is an entirely different matter jorgec5151. These agents are doing the latter, not the former. Indeed, nearly everytime I've gone through this checkpoint in the last year, there have been drug-sniffing dogs running around each vehicle entering the checkpoint & most recently, CBP inspectors have been prominent here.

If you prevent that kind of stuff from crossing into the US you are definetly protecting the border and seeing as how not all of that stuff can be prevented from entering you have the checkpoints which act as a second line of defense and yes they will still be trying to stop all types of trafficking.
This is getting old jorgec5151. General crime control checkpoints are illegal per the U.S. Supreme Court's ruling in City of Indianapolis V Edmond. Regardless of your opinion on what they should be doing at these checkpoints, actively using an immigration checkpoint to look for weapons, drugs, felons, etc is ILLEGAL. If you want to stop these things from entering the country then I suggest you petition DHS to stop diverting scarce border security resources away from the border.

He also didn't want to admit that they had detained him so that he wouldn't have a case saying that his 4th amendment rights were being violated. As long as this is legal gray area, its difficult to make a case. But if the supervisor stated that he was detained, it'd be very black and white.

I wasn't holding up anyone dijhili. Armed Border Patrol agents standing in the middle of public highways no where near the border seizing people absent suspicion were holding up everyone.

@dijhili The driver has the right to expect no encumbrances from government when travelling, unless they have probable cause that the driver, a passenger, or the car itself was/is directly involved in the commission of a crime. The fact is, checkpoints in general are completely unlawful in this land. The driver here was under no obligation whatsoever to answer any of the questions or obey any command or request. NONE.

The first question he asked of Agent Soto was, "Am I being detained?" Soto had a lawful OBLIGATION to answer that question responsively BEFORE any further action by either party was to move forward.

In 8th grade, I was informed by the teacher that the constitution is the supreme law of the land. Later, I was informed by government propaganda of the same fact. 2.) During every debate i watched involving ron paul, there were at least a half dozen blatant indictments made by ron paul about the unconstitutionality of a number of very common things......

And remember, they can print all of the "regulations" and "statutes" they want, if any part of such is against the constitution, then it is VOID. In other words, just because some legislators voted to allow checkpoints does not make it lawful. It is wholly void if any part of it is in conflict with the supreme law (const.).

They chose to argue with me & continue the detention instead of doing their duty by allowing me to go. Of course one of the fallacies people have is that all you need to do is answer their question(s) when in reality the question(s) are merely the opener/pretense the agent needs to gauge a person's reaction, engage in racial profiling, allow a K9 unit to walk around the vehicle, visually search the interior of the vehicle, visually search the exterior of the vehicle, call in identifying information about the vehicle to dispatch, etc.

@CheckpointUSA Actually, if you do admit to being a US citizen then you assert that you have privelleges and not rights. The problem is that neither you nor the BP know that CITIZENS of the US have certain privelleges afforded to them and are subject to the District of Columbia according to the XIV Amendment. Unless, Sovereignty and the right to travel freely are declared then you will continue to be under their jurisdiction.

5:55 - 6:00 the agent asks if you see a STOP sign because you're in a lane of traffic. Is he blind? There is a stop sign over to the left! In that case, you can stop and stay there as long as you want!
The agent's statement was merely a poor attempt to justify his position I believe puppyloveforu. The bottom line is that they were trying to place the blame on me for holding up traffic when they were the ones who erected a checkpoint & stop sign in the middle of a highway that has a posted speed limit of 65mph & were refusing to allow me to leave even though they had neither consent or pc to continue the detention.
The guy that made this video isnt try to be a dick, hes fighting the over reach of government. I like most cops and gov. officials, I know they are just trying to do their job, but they need better training on what the laws actually alow them to do. This video helps educate people, and thats why its worth a watch by every law abiding citizen in America.

Incidental discovery of illegal drugs or firearms is one thing but purposefully using a limited scope immigration checkpoint as a pretext to actively look for such things is an entirely different matter jorgec5151. These agents are doing the latter, not the former. Indeed, nearly everytime I've gone through this checkpoint in the last year, there have been drug-sniffing dogs running around each vehicle entering the checkpoint & most recently, CBP inspectors have been prominent here.

Regardless of your opinion on what they should be doing at these checkpoints, actively using an immigration checkpoint to look for weapons, drugs, felons, etc is ILLEGAL. If you want to stop these things from entering the country then I suggest you petition DHS to stop diverting scarce border security resources away from the border.

The first question he asked of Agent Soto was, "Am I being detained?" Soto had a lawful OBLIGATION to answer that question responsively BEFORE any further action by either party was to move forward.

@dijhili Would any traffic hold up exist in that place on the highway if the agents did not set up the unlawful checkpoint? No. They are the cause ENTIRELY. For the agents to not expect that some Americans would resist having their rights stripped is unreasonable. Of course the officer tried to blame the driver for blocking traffic. He doesn't want the responsibility, even though it's entirely HIS FAULT. I get the sense that you have never studied law, or been in court defending your rights.

In 8th grade, I was informed by the teacher that the constitution is the supreme law of the land. Later, I was informed by government propaganda of the same fact. 2.) @dijhili he won't, for two reasons: 1. assuming he is popularly voted in, the establishment will certainly not let him in. 2. he will not gain enough support from the people. ron paul's position is very similar to those of jefferson, franklin, madison, and other framer generation statesmen. we, as a society, for better or worse, have veered substantially off that path. i don't think the people understand why rp is truly correct on so many hot issues, but sounds so radical.

And remember, they can print all of the "regulations" and "statutes" they want, if any part of such is against the constitution, then it is VOID. In other words, just because some legislators voted to allow checkpoints does not make it lawful. It is wholly void if any part of it is in conflict with the supreme law (const.).

They chose to argue with me & continue the detention instead of doing their duty by allowing me to go. The problem is that neither you nor the BP know that CITIZENS of the US have certain privelleges afforded to them and are subject to the District of Columbia according to the XIV Amendment. Unless, Sovereignty and the right to travel freely are declared then you will continue to be under their jurisdiction.

The agent's statement was merely a poor attempt to justify his position I believe puppyloveforu. The bottom line is that they were trying to place the blame on me for holding up traffic when they were the ones who erected a checkpoint & stop sign in the middle of a highway that has a posted speed limit of 65mph & were refusing to allow me to leave even though they had neither consent or pc to continue the detention.

No one with a BA, MBA or law degree will tell u to cooperate with police. I graduate spring '12 and taking off to law school. I wish more Americans would look up laws and learn their rights. Also, ignorance of the law is no excuse for any citizen but more often then not, I have found officers such as in this video and others to be ignorant of laws which they are taught to enforce.

Additionally, there is no legal requirement to answer their questions. They can ask but have no legal authority to compel an answer.

I didn't say you claimed individuals had to answer the questions but you did imply it as a condition of being allowed to go. Agents need consent or pc to further the detention. Neither of which they had here.
I do acknowledge that you recognize the fact agents can't (legally) further detain you if they say you're not being detained.
