  • ...Continued part 3

    M.W.M.,

If some millionaire owner screwed me over. I made sure it cost them thousands of dollars.

I bleached there precious carpets, and drapes. They had to be replaced. They had to close the restaurant for 3 days, AND pay for materials, and labor, to replace what they already had.

Your owners are idiots!! YOU are the best in the business M.W.M. There was NO cause for ANY problems. They manufactured the problem. THEY TRULY LOST!! Lost the best they had, YOU!!

    Tommy

  • ...CONTINUED PART 2

    M.W.M.,

I've NEVER seen any customer try to pull a fast one by claiming he didn't sign the slip, so he's not responsible. Until one does it shouldn't even be a thought. PUT IT THROUGH.

In the '80s, when there was a lot more sense used by that generations owners, the mgr. or owner simply wrote on the slip. "Signature on file". There was NEVER 1 problem, and everything was covered.

    DAMN those owners M.W.M.!!

    Continued...

  • M.W.M.

Please, you were absolutely right in ALL of your actions. DO NOT, let these disgusting owners "GASLIGHT" you into thinking you did anything wrong.

These current restaurant owners, and managers are so out of line. Constantly trying in every way to cut in on the waiters.

They even have some waiters tipping the kitchen staff. WTF! They're to be paid by the owner. Back to the unsigned check. It happens every day. CONTINUED...

  • I worked a a place where the policy was that if the customer leaves with both slips we don't get the tip, but that was that. We didn't have to have a signed copy. If it wasn't signed we just didn't get the tip.

The place I work at now it is still like that but they have an extra crazy rule. If the same credit card is swiped twice but has 2 diff sigs (maybe the husband signed one but the wife signed the other) then it becomes a big issue, like I can control that?

  • I am sure it is completely not legal for them to charge you once the credit card has gone through, whether there is a signed copy or not. This makes no sense because you can just reprint a copy (of course without the tip). In my last restaurant, if they took the wrong copy but you could clearly see the indentation of the tip and total on the bottom copy (not carbon), you could rub a pencil sideways over it and turn it in as it was intended.

  • That sucks man. I'm a server as well and my place that I work if I were to sign a check yes i would get in trouble but if they took the both checks I dont need to reprint one. I just dont get the tip which sucks ass. One time they did take the credit card check on a 30 top table me and my friend bonnie were on we just put in the system a 20% tip because I'm not taking the fall, i depended on that money. We never got caught although it is wrong.

  • Everyone should weight tables for at least 6 months to realize what bullshit it is.

  • Well shit. Now I can't find you. Come to Ohio and make me a mojito. :(

  • I love listening to you. You are very professional and well spoken. And you have beautiful eyes!

  • Wow, I just want to say that you are truly a professional. With that trait, no doubt you'll find a great career. It's been a year now so I'm guessing you're fine. Good video.

  • I don't think what you did was that wrong. I absolutely think that was the universes's way of telling you you needed to move. I hope all is going well!

  • I used to work at a restaurant, and we were actually TOLD to sign people's receipt if they had not. We were even allowed to correct their math if they had figured in the tip wrong. Obviously not changing the total AND tip, just one or the other number. I think it's crap that they fired you for just printing the receipt with no tip at all and signing it yourself.

  • I'm a Pizza delivery driver (a subset of servers) I've never had a receipt that was double checked, never. I have always made sure that the receipt is signed. I never forged a tip either. If I did the only way they would know would be if a customer called to complained. That would require searching a box full of a month's receipts. I doubt that would happen. It wasn't fair what happen to you. Good Luck.

  • I have been a manager in several fine dining places and ( cause i was a server for so many yrs ) I never took it out on my servers when a guest "forgot" to sign or "accidently" took both slips You absolutely did nothing wrong! As long as u re-printed the slip and turned it in the cc co wil take the slip Not like you added some giant tip on (i have fired server for doing that ) You were right All I can say is that restaurants loss is another ones gain! You are obvi great at your job Be proud!!

  • As a manager ( and I know this is because I was a server for so many years before ) I always took care of my servers I know how often people " forget" to sign their cc slips or "accidently" take both and I never punished my servers for this. I managed privately owned fine dining places so it was easier then dealing with some crappy corporate bullshit rules I have worked for some of those and I prefer the privately owned. It is obvious how good you are at your job. Glad another place has you!!!

  • bah with waiting tables! you deserve your own show! muah !

  • I work for Darden Restaurants, which includes Olive Garden, Red Lobster, and like 3 other chains. And they almost have the same policy as your restaurant, except if the guest leaves with both copies, we don't get in trouble, its just a 0 dollar tip. However, if they do leave a tip and not sign, we don't get it.

Its funny, i put a huge circle on the x where they need to sign, and people STILL sometimes don't sign. But overall, Darden runs a restaurant well, i can't complain too much.

  • I used to work at Olive Garden. I quit a few weeks ago because I had enough of serving. It was actually the best place I worked and I had perfect reviews. I've secretly put an X in an unsigned tip slip. Fuck them. Do I take a ten dollar hit because they are stupid? Too bad. I don't need my job that much.

  • and thanks for your service Vergil555

  • My restaurant accounts for dumb ass guests like this. We are allowed to re-print the slip, no signing, no tip, period. This has happened to me about 100 times in the past 8 years, unfortunately, I have never had a guest call back and try to give me the tip, dirty bastards!!!

  • If you didn't take the tip, then it shouldn't be a problem. That's how my restaurant is anyways.

  • I think it's criminal for a restaurant to make a server pay for someone's meal if they took both slips. The restaurants make so much money and pay servers so little.

  • I worked at a resturant for 3 years as a host/takeaway person. Well a couple months ago i decided i was done with this and that i was gonna join the military. I joined but dident ship to basic for a few months. During that time i worked so i could pay the bills before i go. I ended up flipping off one of my bosses for being a bitch and i got fired. Totally worth it.

  • ohh man that sucks, i always just keep the original unsigned copy, (or reprint another copy) and just turn that in....i didnt know it was THAT big of a deal....

  • katiefershadybaby-you should ask for your money back-you are not responsible if a customer walks out without paying the Bill, the Restaurant has no right and its against the Law to collect money from you if they walk out. Now about the Vlog-If a customer takes both checks, happened to me a few times-I just Reprint and ADD 18% dont sign or try to alter anything-just ADD FCKING 18%. If they mess up the TOTAL do not change it-just put in the amount on the TIP line they wrote.Server more than 15yrs

  • where I work if a customer dines and dashes I have to pay the check. I had to pay 58 dollars once... and I only made 50 that day. ya I fucking hate my place I work at

  • holy shit thats nuts! where i work when dealing with cc slips if the drunk asshole adds wrong between the total and tip line then we dont get the full amt. ( say the wanted to tip 15$ on 45$ but when they added they totaled 50$ instead of 60$ then we get the 5$ instead of the 15$) which i think is shit, cause they ment to tip 15 but they just couldnt freakin add!! Resturant jobs can be great but we get shit on everyday. im so sorry.

  • The world is so random sometimes, you just have to move on. Don't fight fire with fire, just say fuck you and eat some chocolate.

  • you are god, and i love you

  • Some people intentionally swipe the written slip so they don't have to pay the bill, to begin with. Hopefully you've found work since this incident... at the very least, you should be acting!

  • Try to find a new job. I worked at a take and bake pizza chain and though we don't serve people for more than 10 minutes I wanted to shoot myself in the face every time someone walked through the door. I've been a waitress and it's shit work. Basically there's you receive no respect half the time for your hard work. I quit my job on Halloween of this year. Look around for jobs. Don't try and settle for another job where you have to wait tables. I think you deserve better.

  • That is the most ridiculous thing I have ever heard!!!! I work for a credit card company, and the second you swipe the card through the transaction is approved & the restaurant gets their money from the approval code. The fact that they would try and make you pay for it AGAIN means that they are collecting money for that bill twice & stealing money out of your pocket! Greedy bastards! You did nothing wrong.

  • You use Word? LOL!

  • You may not have defrauded anyone, but I think you did impersonate someone under the law... Maybe check out paragraphs on identity theft, etc. in the legal code. That aside, your company's policy (and indeed any company that does this) of forcing you to cover the bill if they take both visa slips, run out on their bill, etc. is fucking bullshit. In no circumstances should that be legal, and it certainly is not acceptable. I will not work in a place that does this.

  • again, identity theft is another form of fraud, listen clearly his quoted definition of fraud and the detail about the victim being worse of after the incident. As for you YouDailyTop, you got hosed, plain and simple. no crime was commited, the customer didn't press any charges for identity theft/fraud etc. Anyway, thank you for what you do. Thank you for educating customers and servers alike in our sometimes chaotic industry.

  • one of the first things you said was that the "pros outweighed the cons, which is rare in your industry" and thats why you stayed......yet at the end.. you said you wanted to leave anyway....... wtf?

  • When I was first hired, that was true and that was why I stayed. However, as I'm sure you know, things can certainly change during the course of one's employment... and the pros eventually no longer trumped the cons (which hopefully my story illustrated).

Thanks for watching (and listening carefully) and for giving me the chance to clarify.

  • this is true. the grass IS always greener on the other side of the fence.. especially when you first get there. hahhaha

  • With such high stakes on something you don't have much control on during a busy shift I could see why you did what you did since it wasn't fraud you just corrected a minor detail. The penalty for a missing cc slip should be just losing the tip but that's just ridiculous how you would be disciplined so harshly

  • That sounds so stupid that you need the credit card receipts. My restaurant just has a policy that we wouldn't get any tips that are on it. They can reprint it from the computer. Isn't it legal to do that to you?

  • I am glad that at least in your position your supervisor was willing to write you a reference. And hooray for you doing your homework! I'm currently doing mine as well...I hate when people *don't* do their homework and then complain about getting screwed over.

  • My boss called me into the office and immediately terminated me...I was not given the opportunity to explain myself, and I was made to sign a form (which I later found out I had the right to refuse) stating that I did smack the child, which could permanently damage my chances of working with children again...I think in any situation where the employer/boss/etc. did not witness what happened, (and even in some cases if they did), the opportunity should be given for the accused to explain.

  • Okay, so I don't work in the food industry (although I'm about to apply at a restaurant), but I want to say that I am 100% with you on this point. I was just fired Monday from my job as a teacher at a child development center because two of my co-workers accused me of smacking a child...I would NEVER do such a thing, and in reality, what I did was move the child's hand out of the way so she would not keep hitting another child on the head. However...(continued...)

  • Get an attorney NOW! and dispute the form. If you wait one more day, say good-bye to your chance to EVER dispute it. Period. If you don't, you give up your chance to complain or be believed.

i am not disbelieving you at all, just trying to explain the situation. Best wishes.

  • Aardvark is right. Get an attorney.

  • where I worked, big big corporate place, basically if someone left without signing their slip you just forfeit the tip. it's not the end of the world there. sometimes they take the wrong slip and you can see the indentations from their pen markings on the top slip, when that happens you are technically unable to claim that tip, but occasionally servers will trace over it. which can get you fired obviously if they catch you.

  • I've done this job for several good companies myself. Anywhere I worked, the guest could leave w/o signing the slip or take it with them, and I would just lose the tip. I would never have to pay for their meal. With stakes like that, I would just eat the tip if they took off with both slips. (if the stakes were me paying for their meal... then I'm not sure... I lost less than 10 slips, so I never dwelled on it)

  • isnt it common knowledge that when travelling away from australia the "done thing" is to tip 10-20% ?that sucks you work hard sucking butts on tables and being nice when you dont want to you poor thing are you for real?give me the ex bosses email ill give him a nice line or 2 or just the name of his sorry place karma will get him m8

  • I would have just reprinted it and NOT signed it. Thats what i do. And I make a manager aware that someone did not sign.

Sorry you got fired man. Hope an audition come thru soon.

  • LOL around 9:00, i can tell you've lived in L.A.! The universe is our driving force to us angelinos! I bet New Yorkers would just say "tough sh*t"

  • lol, that's retarded about them not signing it..my restaurant just assumes it's a 0.00 tip and they saw it.

  • The idiot manager ran this guy's ticket on his friend's credit card. I tried to explain to her what she did, but she wasn't hearing that. It was late so I finally said, "F**k it, I'm going home." I had the next two days off and the next day, the man who had his card charged twice called and wanted to know why there were extra charges. So the manager (not the same one since we have three) talked to me. Guess who had to pay out of her own pocket to refund the guy's money? That's right. Me.

  • All the servers were being double and triple sat left and right. I kept getting double sat with 8 tops. Yes, I banked that night! But at the end of the night, when I went to enter my CC tips in the computer, I accidentally deleted one of the guys' ticket. No problem, I'll just have the manager force the number in the upstairs and, aside from getting yelled at for deleting a credit card, everything will be copascetic, right? Wrong.

  • I had the same type of thing happen to me. It was a busy Friday night and I had an 8 top of old men who ordered steak and wine. When they paid, they were all on separate checks and they each paid with credit cards. Now, they all must've belonged to the same club or something because each man's credit card was exactly like the others with the exception of a few numbers being different. And at this time, I was getting slammed!

  • That's just suck!

  • Some management s are the assholes that treats servers like shit.Well, maybe not in the exact but if they make you pay for the customers that is retarded then it is a sign that this job might not be for you any longer.I have heard of this kind of treatment but thought that it was a urban legend among all the waiters and waitresses.Wow!Now I know that it's true.

  • I'm with you man. I just got let go as a cashier. (I know I know) My drawer was short $20 and after a suspension I was let go. After 4 years of employment, I thought I at least deserved a second chance.

  • Pull a palin and get the heck out

  • I just want to say that what you did was no "out of the norm". We used to do this at the place I worked and as a matter of fact my manager was the one who said to just sign it no biggie. I love your videos you make me laugh sooo hard. The coin video had be rolling on the floor. Wish I would have had a venue like this to vent it would have saved me a lot of money I spent on drugs!! LOL Carol

  • I am with you. I ran into a couple of situations like that and it was no big deal to the owner or my manager. As a matter of fact my manager was the one who told me that it was no big deal (to do what you and I did). They got their money and I got my tip...no hart no fowl. Good luck with your job search. Carol

  • Most customer's won't fix it because like he said - they won't be thinking about that unsigned or taken CC slip when their bill comes in the mail. So what you are saying is that it's ok for the customer to steal from the restaurant? That it's ok for the waiter to be held responsible for that customer's theft?

  • The wait staff should never be held liable for customer theft. Honestly, I don't see the issue so long as you did not add gratuity to the slip you signed. Termination was extreme, and I say this from the P.O.V. of a customer.

  • yes, you did deserve it. You committed freaking crime and should be in jail. I've watched your pathetic, whining vids, and arrived at this conclusion. Your too stupid to do anything else. Life's tought, get a fucking helmet. ....idiot

  • "YOUR too stupid . . ."

    Oh the irony.

  • Yep. I'm with you and YOU'REs. Way too funny. So the customer, (who simply made a mistake) is not held responsible, but the waiter is? Nope. Tip guy was fine. I woudl have ben fine with it as a customer just so I would not have to turn around half way home and go back to sign.

  • What stupidity make the server responsible, that the server has to break the law due to a customer screwing up? Yeah, you got fired for good cause, under the law, but the law is a bunch of horse hockey. If anything, a customer leaving and not paying should be a management issue, NOT the server.

  • You fucking scumbag you forged someone's signature you don't deserve a job anymore.

  • its not a scumbag move at all....hes responsible because some shithead walked out with both copies....trust me, it happens all the time in restaurants.....

  • Many credit card transactions in this day and age do not require a signature.

  • Why are you dragging the other serves into your shit blog? What did they do wrong? At least they don't have a blog devoted to bitching about every little thing their customers do. You stupid fuck, I'm paying your bills, so bring me my water and stop whining.

  • so what happens at bars when people put down a credit card and then leave without closing out their tab? most places charge a 20% grat, but still there's no signature? who knew the signature part was so important?

  • Dude, I feel for ya. I've been in nursing the last two years and I recently was let go over a falsified report against me based on evidence that didn't even exist. I fought it all the way through a hearing, and in spite of the vulnerable adult the claim was over changing his story several times and actual witnesses speaking on my behalf, the claim remained substantiated. It blows how the system can get away with this stuff, but it happens.

  • like your videos

9 years waiting, that sucks what a shitty job

  • There should be a bill passed called the "Nickel and Diming Man's Act". It should cover all the stupid stuff working people deal with in order to keep their jobs. Illegal policy is still illegal policy and the company should be terminated too.

  • I don't know how it is in LA, but at least in Chicago according to our wage and labor laws you are not allowed to be responsible for unpaid customer checks, or even if you break a glass or something like that they cannot by law charge you for it. Especially if the customer used their card to pay; they can't take money from you for something already paid for, even if the check slip is missing. All of that is illegal too.

  • ooh thats not fair :(

  • I dont think what u did is wrong its not like you fabricated a tip. She had the intent to pay her bill and took the slip on accident, your owner is rediculous... when people take their slips i dont even reprint them i just finalize it in the computer without tip. Servers cant be at their tables all the time to ensure people cross all the t's and dot all th i's .. if that owner is so anal he should have people pay their bills to a cashier at a register and not lay the responsibilty on servers.

  • My restaurant could care less about credit card receipts. Most servers do not even keep ones without tips! That was so unfair. But hopefully you will get a better job!

  • WHAT A BUNCH OF MORONS..NOT U

  • nine years and 20 waiting jobs - now there some questions...

  • Again, sorry you got a raw deal, and it's probably just a blessing in disguise. You'll find a better job!

  • So sorry to hear about that bullshit you were put through. People are so stupid in restaurants sometimes. At least once a week, I have someone ask me for a pen right as I drop off the check, and when I look at them all confused, they tell me they need to sign, and then I remind them that I have to run their card first. That's always a chuckle. But I know the situation of people taking both copies or not signing. I always feel awkward taking the check before the guest leaves though. Tough call.

  • Wow man you take your job seriously lol that's a good thing. I don't think that you did anything wrong man seriously just fuck the owners!

  • It's one of your better videos for the reason that you're not shouting and pissed. Intriguing story by the way.

  • The peope you work for are poor very poor indeed their actions do not justify their action to fire you you need to move on and they will pay for their stupidity. I wish i knew what restaurant cause i would not eat their again.

    Fuck them.

  • Hey man, Im really sorry for what happened to you, I was once fired by a stupid manager who gave me a stupid reason to fire me, and the truth is that I was about to quit right before that , the place was not worth it.I found me a better job, things happen for a reason, Im sure you are gonna get a better job sooner than you think buddy!

  • I do not fee that you have done anything wrong. I think it is their fault for making such strict rules about things you cant even control, if those were not in effect you wouldnt have had to sign the slip in the first place. How can you get written up because someone didnt sign their check? You cant control that. I think a lot of places have really dumb rules like that. However, i can tell you are very good at what you do and very experienced and i am sure you will find another job soon.,

  • Intent to defraud? I wonder if they fired you because they saw your Youtube vids.

  • you are soo hot!!...sorry for what happened to you.. but come on.. your experience is gold!!!... and .... i think that for you there are going to be some better opportunities!!

  • I've had people do that to me all the time. I've actually ran out of the restaurant and stopped the customers as they were driving away in their car to retrieve my copy of the check.

The few times the customer actually got away, I entered the check in with no tip and forgot about it. The manager never asked me why the check slip was not in my final report. I guess my restaurant is more laid back in that way.

Sorry to hear about what happened man. I hope you find a new, and better job soon :)

  • Ahh, you didn't do anything wrong. You should have put 20% on the check.. then signed it.

I work as a server and a bartender.. and at the bar I work at our boss says if people don't leave a tip on the credit card receipt.. we are supposed to put 20% then run it through!!

Everyone who comes in there is a regular.. but it happens every now and then.. and that is what we do.

You didn't do anything wrong at all.

  • Guests need to be more careful with using credit cards in the restaurant. They don't realize that thier stupidity could cost someone thier job.

  • In our restaurant, this happens all the time. I end up with AT LEAST one unsigned credit card slip every shift. The way my place deals with it, is that you can only get fired if the customer disputes the amount of the tip or check. Showing there was some kind of "deception" on the server's part. Which is rarely the case. Usually, they just forgot to leave a copy and as long as the totals match the guest's two copies, the server is fine.

  • i lost my job as a server in a very identical way...but i took it as a sign to retire as a server, and i haven't look back...i can tell by your vids that you are passionate at what you do and youtube is your vent machine...hope you land back on your feet and keep these insightful and entertaining vids coming.

  • Thank you!

Trust me, I feel like I get signs all the time that I'm not supposed to be a server anymore. ha. But it's one of the few things out there that affords the availability to pursue my aspirations while still being able to pay the bills...

  • I would like to think that if ownership at that establishment acts this way towards its employees then you'll be better off somewhere else. Good luck to you. As a fellow server your weekly vlogs are definitely fun to watch and somewhat therapeutic for me. Keep them coming and good luck on the job hunt!

  • Dude, that completely sucks. I really feel bad for you. Almost sounds like it was a little political, since you say you've never been written up for anything since you started. I've worked as a server before, and I know all that stuff you speak of is sound. Been there, I got fired for one mistake, and I KNOW the manager could have been lenient... You have to have eagle eyes no matter how busy it gets. Hope you land on your feet soon. I really dig the videos!

  • I know, it does seem a little political. Mgmt would say that other servers' write-ups were not as serious as a forgery (even though, as I proved, it wasn't)... but I actually know that not to be true.

The owners have their reasons for keeping certain servers working there... and that's all I say about that!

And thanks for the compliment and support. Keep watching!

  • I'm sorry you got treated that way.... Sometimes there are just those random, unexpected circumstances that can put your job on the line. But hopefully you'll find light at the end of the tunnel. I've worked in some pretty bad restaurants that treated their employees like dogs. But, you resurface and move on... The worst part about going to another restaurant is learning a new menu and computer system. But being a "veteran" server it's fairly easy to catch on.. GOOD LUCK! =)

  • Thank you!

  • Ah my darling I can't beleive you lost your job. At my work it's not a big deal if they don't sign the tip - and never has anything been withheld from me.

The way I look at it, once you swipe the card and its through the system and paid and the tip is entered I HIGHLY doubt anyone is going to call and dispute the bill. Not for a meal they were THERE for !

Secondly, with all these chip cards it's hard to commit credit card fraud these days.

I have more to say, write you private msg.

  • Yes, the point is customers never call if they've agreed to pay a certain amount, but happened to forget they signed the check. You think they remember they forgot to sign it? Like a month later they're going to see their CC statement & think, "You know, I actually don't think I signed that check, so I'm going to dispute this charge!"

But that is exactly what the owners of said restaurant are fearful of. We servers are not responsible for such things.

    Thanks for your continued support!

  • i just put my two weeks at my place on sunday, pretty happy to leave too. i just wanna say first off on behalf of every server out there, thank you for your videos they really give light to some of the difficulties servers go through everyday. at our place if a customer leaves or takes their receipt with them you dont get the tip obviously, but the server is not liable for the tab..that's pretty absurd. whenever a customer forgets to sign their receipt i just do what you did and sign it myself

  • Thanks for expressing your thankfulness. I happen to sincerely appreciate your watching and kind words.

And glad to know you are like legions of servers who at times sign unsigned receipts. Hell, it was another server that night who told me during my state of panic, "Just sign it. We all do."

If only the owners had a clue. It's almost comical how they blew this up to such a big deal. Oh well... it's a bless in disguise.

I wish us both luck as we search for new jobs!

  • I am so sorry that you lost your job. I am sure you did not intend to do anything wrong.

  • Thank you.
